CROSSFIT LEVEL 1 TRAINER LICENSE AGREEMENT CrossFit provide
2、s a fitness program for strength and conditioning. In the interest of making its fitness techniques widely available, CrossFit encourages individuals and entities that understand and agree with the CrossFit method and philosophy to become CrossFit Trainers. In consideration of the importance that th
3、e Level 1 Certificate holders play in spreading the CrossFit program and philosophy to the wider public, this Limited License is granted to all Level 1 Trainers upon successful completion of the requirements for receiving a CrossFit Level 1 Trainer Certificate. Use of the CrossFit Brand Name and Oth
4、er Trademarks, Grant and Scope of Limited License: 1. Only licensed CrossFit Affiliates are allowed use the CrossFit brand name to describe the training they offer. They enter into a licensing agreement with CrossFit, Inc. and pay for the rights. CrossFit Level 1 Certificate holders may not use the
5、CrossFit brand name except as follows: He or she may: (1) list the CrossFit Level 1 Trainer qualification on a business card, (2) list the CrossFit Level 1 Trainer qualification in a trainer biography on a website. However, unless it is the website of a licensed CrossFit Affiliate, the website may n
6、ot use the CrossFit brand name or any confusingly similar name (e.g. XFit, CrossFitness, etc) anywhere else on the website. (3) list the CrossFit Level 1 Trainer qualification on a resume, curriculum vitae, or professional biography; Trainer understands that no agency, partnership, joint venture, em
7、ployee-employer or franchisee/franchisor relationship is intended or created by this License. Trainer shall indemnify, defend at CrossFits request, and hold harmless CrossFit, and CrossFit, Inc.s officers, affiliates, directors, agents and employees from and against any and all actions, claims, liab
8、ilities, losses, damages, expenses, and costs (including court costs and attorneys fees), without limitation for: (a) breaching any of the obligations by Trainer; (b) infringement or misappropriation by Trainer of any intellectual property of any third party; (c) or property damage, personal injury
9、or death based on Trainers negligence, recklessness or willful misconduct. 2. Persons who have not passed the Level 1 Test or who have not received a current and valid Level 1 Trainer Certificate may not do any of the things permitted to Level 1 Trainer Certificate holders in paragraph 1 above 3. Th
10、e term of this Agreement will begin on the date Trainer registers for the CrossFit Level 1 Trainer Course. This Agreement will continue in effect until: i. Trainer violates any provisions of this Agreement and CrossFit, Inc. provides notice of the termination along with its reasons; ii. Trainer ceas
11、es to be qualified as a CrossFit Trainer due to changes in the requirements for maintaining such qualification which Trainer does not comply with (such as continuing education requirements); iii. Trainer becomes a licensed CrossFit Affiliate in which case this Agreement is superseded by the Affiliate License Agreement. IN AGREEMENT WHEREOF, the Trainer acknowledges the terms of this Limited License and his/her Agreement by clicking below.
