12、罚：1、由于冒险蛮干或玩忽职守造成伤亡事故的；2、由于违章作业造成伤亡事故的； 3、发现有事故危险的紧急情况，不立即报告、不积极采取措施而未能避免或减轻事故的； 4、由于不服从管理，违反劳动纪律，擅离职守或擅自启动机械设备造成伤亡事故的；5、由于不按规定穿戴个人防护用品造成伤亡事故的。6、由于不按已批准的施工技术方案施工造成伤亡事故的。 第四条 因违章指挥或违章作业等责任事故，使单位遭受经济损失的，单位可以根据具体情况，责令有关负责人和直接责任人员赔偿全部或部分损失；第五条 处罚发生伤亡事故，除政府安全生产监督管理部门处罚外，项目还要对发生事故的单位进行处罚，办法如下：1、一次事故造成重伤1人
13、或轻伤35人（不含）的，或者直接经济损失2万元5万元（不含）的，罚发生事故的单位500010000元； 2、一次事故造成死亡12人或重伤35人（不含）的，或者直接经济损失5万元50万元（不含）的，罚发生事故的单位10000元； 3、一次事故造成死亡3人及以上或重伤5人及以上，直接经济损失50万元及以上的，罚发生事故的单位元；4、对于破坏事故现场或发生事故隐瞒不报、弄虚作假的单位，以高出原罚款数的1至2倍数额加重罚款；第六条 未发生伤亡事故的违章作业按照以下标准处罚：一、关于项目经理部的不安全行为处罚执行标准1、生活区使用大功率用电器（1500W）未经审批，空调除外；2、经审批的大功率用电器未接
14、入指定线路；3、偷电、私自修改用电电路； 以上执行A标准4、未经审批使用灭火器的行为，发生火灾和进行消防演练除外；5、未经允许使用经理部车辆、无证驾驶、酒后驾驶的行为；以上执行B标准 6、偷盗行为；7、恶意破坏公共财产，造成安全隐患的行为；8、擅自修改经理部防盗、监控等特殊用电线路。以上执行C标准 9、不安全行为或发生安全隐患接到整改通知未及时整改的行为；10、不安全行为或发生安全隐患接到安全指令未按要求采取措施的行为；以上执行D标准二、关于项目部爆破器材库房的不安全行为处罚执行标准1、管理员私自离开库房造成无人看守行为；不带工作证；2、管理员私自离开库房造成无人看守行为； 3、未按照规定审批
15、制度放行爆破器材的行为；4、未经安保部同意私自带人（含任何人）进入库房的行为；5、进入库房未上交易燃易爆、电子产品等容易引发不安行为的；造成器材丢失或事故的行为；6、发现隐患不及时上报造成财产损失的行为；7、四级风以上仍使用外燃设备的行为；以上执行B标准11、未按项目部制订的民爆管理制度规定的其他行为；三、关于工区（施工现场）的不安全行为处罚执行标准1、进入施工作业面200M范围不带安全帽的行为； 2、违反“工作车辆进入工作面必须听从现场指挥，停靠位置不得干预施工”的行为；3、 未按照安全操作规程放置施工用品和违章操作的行为；4、有防护用品不使用的行为；5、实行挂牌制度后未安全规定挂牌的行为，
16、从第二次开始处罚。以上执行A标准6、未按要求进行施工安全技术交底、安全培训的行为；7、冒充他人在交底登记上签字、在动火使用审批单上签字的行为；以上执行D标准8、无证操作、无证驾驶、酒后驾驶的行为；9、施工不戴安全帽或安全帽配戴不规范；10、施工期间吸烟、使用明火等行为；11、接到安全隐患整改通知未及时整改的行为；以上执行B标准12、接到安全指令未按要求采取措施；13、一个月内接到同一安全隐患整改三次的行为；14、一个月内接到同一安全指令三次的行为；以上执行E标准四、对于上述未规定的其他违反相关法律法规未造成人员伤亡的行为视情节轻重进行处罚，构成犯罪的移交司法机关。根据不同情况，现场工区负责人员和技术
