4、促进外观设计的保护与利用，鼓励外观设计的创作，促进产业的发展。本文采用比较分析、案例分析、规范分析的方法对中日特殊外观设计授权要件进行比较研究，以期更拓宽对外观设计法律保护的认识，为我国外观设计立法提供参考。本文第一章绪论，首先介绍了本文研究范畴、现状、目的、内容与方法。第二章引用分析了中日两国具有典型代表的特殊外观设计案件，以提出当前两国特殊外观设计上的问题。第三、四、五章对中日特殊外观设计授权要件的规范、学理、产业环境分别时行了比较分析。第三章规范分析作为全文研究基础，对特殊外观设计的授权要件与对其限制进行了归纳；第四章，对法律规范背后的学理依据与争论焦点进行梳理；第五章，对特殊外观设计制
5、度产生的产业环境进行了恩考。第六章对日本特殊外观设计授权要件现实的法律效果进行归纳总结，并对我国特殊外观设计专利授权要件制度的发展提出意见。关键词：中日比较特殊外观设计授权要件I华 中 科 技 大 学 硕 士 学 位 论 文AbstractAt present, with the rapid development of appearance design in China, the protectionof the appearance design is being more complicated. Especially the particularity ofdesigning cre
6、ation mode, the relevant regulations should adopted accordingly to cope withthe appearance design. In 2008, the Chinese patent law added the association ofappearance design protection clause. In the form of special design to strengthen theprotection for appearance design is an important law system i
7、n our country in the future.Although in Japan the appearance design is protected by special legislation,the purposeis consistent with the patent law in our country, which is to promote the conservation andutilization of appearance design, encourage the creation of the design, promote thedevelopment

The paper researches the special authorization requirement ofappearance design withcomparative analysis, case analysis and normative analysismethod， in order to broaden the understanding of appearance design of legal protection,provide a reference for our design protection legislation.I
9、n this paper, the first chaptert introduction, introduceds the researching category, thepresent situation, the purpose, content and method. Chapter 2 analyzes the specialappearance of the typical design cases in China and Japan, in order to put forward thecurrent special designproblem of the two cou
