1、I饲养动物致人损害责任的承担摘要饲养动物致人损害责任，是社会中客观存在的一种侵权责任。随着社会的发展，人们管领动物的范围日趋多样并复杂化，由此造成的相关损害也接踵而至。动物致人损害责任的地位日益突出，成为侵权责任体系中不可缺少的部分。新制定的侵权责任法对饲养动物致人损害责任作出了比民法通则更为详细的规定，是我国立法上的一大进步，也使司法实践中的不少问题得到了解决。但侵权责任法关于饲养动物致人损害的规定只具有原则性，欠缺具体操作性，并且在责任承担主体、损害赔偿机制等方面还有待于进一步完善。本文针对我国饲养动物致人损害责任承担的问题，从以下三个方面进行讨论，以求对其有一个较为全面、整体的认识。第一
2、章是饲养动物致人损害责任承担的概述。通过阐述饲养动物致人损害责任承担的理论基础、饲养动物致人损害责任承担的构成要件以及饲养动物致人损害责任承担的基本原则等问题，阐明饲养动物致人损害责任承担的原因以及相关要件。第二章是饲养动物致人损害责任的承担主体。本章从饲养动物致人损害责任承担主体的概述、侵权责任形态、国内外立法关于饲养动物致人损害责任承担主体的规定、饲养动物致人损害责任主体新探等四个方面对饲养动物致人损害责任的承担主体进行了研究。通过对饲养动物致人损害责任的承担主体进行国内外立法比较，并在此基础上结合我国的司法实践以及国外立法的先进经验，对我国饲养动物致人损害责任的责任承担主体的完善提出建议
