4、分析，一般把生物多样性的价值分为经济价值、生态价值以及人文价值等。在实践中，生物多样性锐减已经成为当今国际社会广泛关注的话题，因此，无论在理论研究上还是对于指导实践，生物多样性保护的研究都非常必要。 本论文主要包括以下内容： 第一章 绪论 该部分主要介绍本课题的研究背景、目的和方法。 第二章 生物多样性保护概论 首先，根据国内外权威学者专家对生物多样性的涵义进行分析，涵义的主要内容包括其概念、法律特征以及调整范围。其次，介绍了生物多样性保护法律的历史沿革及现状。再次，分析了生物多样性保护的必要性和紧迫性。 第三章 中外生物多样性保护的法律制度之比较 该部分主要从中外有关生物多样性保护法律的立法
5、目的角度、监管体制角度、法律体系角度以及国内外对生物多样性的救济等角度对生物多样性保护法律制度进行比较。通过对中外生物多样性保护法律制度的比较， 从而为第五章完善我国生物多样性法律保护的路径选择提供借鉴。 第四章 我国生物多样性保护法律制度的现状及原因分析 该部分分别从理论研究角度、立法目的角度、公众参与角度、生态效益补偿角度以及监管体制角度对我国生物多样性保护法律制度的现状进行了深入的分析。通过分析我国生物多样性保护法律制度所存在的问题，从而为寻求保护我国生物多样性的法律路径做好铺垫。 第五章 完善我国生物多样性法律保护的路径选择 在借鉴国外先进法律制度的基础上，结合我国国情，通过重新构建立
