3、制度方面的创新，其在我国的发展正走向深入。在我国，村民自治的发展大致可分为四个阶段，即初创性阶段、试行性阶段、整体探索性阶段、推进性阶段。目前，我国村民自治的实施已取得了阶段性成果与重大的进展，村民自治性组织也在全国范围内普遍存在，有关村民自治的法律制度也逐步成熟。 然而，在我国村民自治在取得重大成就的同时，其在实施过程中却存在诸多问题，特别是随着社会主义新农村建设的推进和依法治国方略的深入发展，村民自治中的法律实施问题日益凸显，迫切需要从立法上加以完善。这些问题主要表现在：村民选举制度不健全； 两委关系有待进一步协调； 乡镇基层政府与两委的关系不清；大量农民工外出打工给村民自治带来的不利影响
4、等等。为了推动村民自治的健康发展，笔者分析了村民自治的发展历程，剖析了现行村民自治的基本制度，结合相关法学理论，在实地考察的基础上提出了完善村民自治的相关法律对策。 第一部分，介绍了村民自治的历史起源与定义，阐述了村民自治的发展历程。注重从根源上探究村民自治存在的历史以及目前在我国的发展阶段问题，同时探究村民自治的定义。 第二部分，主要以山东省聊城市堂邑镇刘庄村为调研对象，针对该村自治的现状及其存在的问题展开分析。其存在的问题主要有：缺乏统一的村民委员会选举法 ； 村民委员会组织法不健全； 村民自治法的缺失； 宪法对村民自治法律制度的相关规定不健全。 第三部分，对当前村民自治法律制度实施中存在
5、的问题进行分析，主要包括：村民自治之选举制度的困境；村民自治之财务法律制度存在缺陷；村民自治之村规民约面临的实施困境等。 第四部分，针对村民自治法律制度中存在的主要问题提出五点建议。一是完善村民选举制度，推动村委会选举法的制定；二是加快村民自治法的立法进程；三是完善与修订村民委员会组织法及宪法中有关村民自治制度的规定；聊城大学硕士学位论文 ii 四是完善村民自治的财务法律制度；五是制定并实施村民自治的人才发展方案 。 关键词：关键词：村民自治；法律制度；实施；民主选举；村民自治立法 聊城大学硕士学位论文 iii ABSTRACT Villager autonomy,As one innovat

Relevant laws and institutions become mature correspondingly.However,some problems have arisen in the process of im
8、plementing the villager autonomy.Particularly with the advance of new socialist countryside construction and development of basic strategy of governing the country by law,law problems in villager autonomy become more prominent,its urgent to improve it in legislation autonomy.For example,the electora
9、l system is not perfected,the relationship between the villagers committee and the Chinese communist party branch in village are need to further coordination， it is not clear that between the township grassroot government and the Chinese communist party branch in village，it is unbalanced development
