1、摘要：本文在现有的资料和有关案例基础上，分别在英国法律和美国法律下阐述交，还船时间和租期的关系以及产生的法律后果，并以定期租船合同纽约产格式( N Y P E 【1 9 4 6 ) 为例，结合实际操作，从租期的开始交船，到整个租期的时间，再到租期的结束一还船，力求覆盖整个完整的租期过程，以及有 L 关租约条款。j1 租期开始一交船租期从“交船”开始。即把船舶和船长、船员的服务交于租船人的处置中，能让租船入充分和完全的使用船舶。通常只有当船舶具备了租约中规定的交船时间，交船地点和交船时船舶状况才算交船，租期开始。当延迟交船的情况发生后，租船人在N Y P E 中可以根据第1 4 条款销约条款，解
2、除租约。由于此权利是租约特别规定的，因此租船人有权解除租约，但并不等于有索赔损失的权利。2 租期还船日期应视为大致的日期，除非双方使用了十分明确，强烈的字眼规定了租船人完全有义务在某个日期前还船。在这大致的日期内，或明示，或暗示，只要租船人有合理的依据预计船舶将在规定日期的合理时间内还船，他安排船舶营运最后一个航次，并不构成违约。3 最后航次在租船人合理的预计下船舶能够在租期内，包括任何明示或暗示的差额或偏一j 差，能够完成最后一个航次，则船东应该遵守此航次。如果租船人没有合理的预f 计使得船舶不能在租期内完成最后一个航次，那么船东有权拒绝租船人指令并要t求一个新的合法的最后航次指令。如果租船
3、人没有给新的指令，船东可认为租船人毁约，可撤船并索赔损失。4 索赔计算索赔的原则是恢复原状。在“P E O N I A ”案之后，不管最后航次是否合法，船东都有索赔延迟还船的权利。能够索赔的损失通常是指市场租金差价。5 提前还船提前还船是毁约，无辜的一方可以选择接受毁约，并提出索赔，或者拒绝还船，要求另一方继续履行合约。6 租期结束一还船。租船人将是违约，如果在还船时船舶没有良好的状况，正常损耗除外。船东有权要求船舶交还在租约规定的地点或区域。租船人有权在租约规定区域内的任何地点还船。在给还船通知的时候，通常比较好的做法是逐步提高还船时间预报L 的精确度和缩小还船地点的范围。 l _ ，_I-
