1、上海交通大学 MPA 学位论文 上海市长宁区政府信息公开问题与对策研究 I上海市长宁区政府信息公开问题与对策研究 摘 要 政府信息公开，是指国家行政机关和法律、法规以及规章授权和委托的组织，在行使国家行政管理职权的过程中，通过法定形式和程序，主动将政府信息向社会公众或依申请而向特定的个人或组织公开的制度。信息公开是信息时代民主与法治的重要内容。建立以信息公开为核心的政府信息公开法律制度已经成为世界性的趋势。 我国是人民民主专政的国家，政府信息公开是人民主权原则的要求，也是我国实行民主法治的题中应有之义。自改革开放以来，中国社会政治、经济、文化和社会等领域发生了全面性的社会变革，由传统农业社会向
2、现代工业社会、高度集中的计划经济体制向社会主义市场经济体制、政治国家向公民社会、封闭型社会向开放型社会转变，初步实现了中国特色的社会主义现代化。在这个过程中，政府从无限的政府越来越走向有限的政府，从人治的政府越来越走向宪政和法治的政府。信息公开制度的实施，对中国政府自身建设来说，为建设法治政府、责任政府与服务政府奠定了基础。 2004 年，上海市出台了上海市政府信息公开规定 ，据此长宁区也成立了政府信息公开联席会议，开展了政府信息公开工作。在工作推进过程中，逐步探索出一些政府信息公开的工作方法和管理规范。同时，由于管理体制、领导干部思想意识上的原因，信息公开工作也存在一些突出的问上海交通大学
3、MPA 学位论文 上海市长宁区政府信息公开问题与对策研究 II题。本文是立足于上海市长宁区近 4 年来政府信息公开工作收获的经验得失，从公民参与的管理理念，保障公民知情权的法理角度和实现信息资源开发利用的实用角度分析现阶段我国政府信息公开工作存在的难点、瓶颈和障碍，并重点在操作层面进行流程创新，提出改革举措，以探索形成一套符合当前行政环境，满足社会公众对政府信息公开需求的政府信息公开监督管理制度和模式。 全文共六章，第一章阐述课题研究的背景、目的和意义，第二章阐述政府信息公开的概念和理论基础，第三章介绍我国推进政府信息公开工作的背景和现状，第四章介绍上海市长宁区推进政府信息公开的情况，第五章分
