1、中南民族大学硕士学位论文 I摘 要 行政信访制度作为我国特殊的救济和监督制度在司法外为信访人提供了一条救济和监督的途径，但最近几年，随着全国信访总量的不断增长，信访工作领域内的矛盾不断凸显出来，有关行政信访制度的改革也就成了学术界讨论的热门话题。信访制度究竟应当是废除还是改革？如果要改革，应当朝哪个方向改，应当如何改？这些都是学术界讨论和研究的课题，也是实务界非常困惑的问题。笔者从信访制度现行制度的构建、存在的理由和发挥的社会功能着手研究，试图揭示信访制度存在的问题和造成问题的原因，以期在此基础上提出切实可行的完善方案。通过制度自身的完善和整个社会法治建设的发展使其继续发挥应有的作用。 基于此
2、，全文共分成以下三个部分： 第一部分对行政信访制度基本理论的阐释，作为本文研究的起点和前提。首先，在比较分析相关学者对行政信访的概念界定的基础上，笔者提出了自己对行政信访的含义的理解；其次，对行政信访制度的发展沿革进行了梳理，将其分为六个阶段；再次，对行政信访制度存在理由进行了分析，认为其具有社会安全阀的潜质、具有坚实的法治基础、同时符合传统文化的理念；最后对行政信访制度所具有的功能进行了相关介绍。 第二部分对行政信访制度现状及存在的主要问题进行了分析。 首先， 基于 信访条例规定的框架对行政信访制度进行了介绍；其次，指出了我国行政信访制度存在的主要问题，诸如信访受理大量越位，闹访、缠访严重，
3、越级访、反复访屡有发生等；最后，对存在问题的原因进行了分析，如制度不健全、信访机构缺乏统一协调机制、信访监督力度不够等，因此我们需要对制度进完善，使其在正确的轨道上发挥功能。 第三部分则对行政信访制度完善方向提出了合理化建议。首先信访条例已经为我们的制度自身完善提供了方向，因此笔者提出相关制度的完善途径，包括听证制度、责任追究制度、信访终结制度、领导接待日制度等的完善；其次，通过外部环境的完善促进行政信访制度自身的发展，主要包括加强立法、整合现有信访资源、促进司法独立、发挥社会监督机制的作用等。 关键词：行政信访；行政信访制度；问题；原因；完善 行政信访制度研究 IIAbstract The

Should the Administrative Letters and Visits be abolished or reformed? If it should be reformed, which direction shoul
6、d change toward, how should it be changed? These are the discussion and the research topic in academic circle, is also the confused questions for practical realm. The author studies from present construction of Administrative Letters and Visits system, the existence reasons and the display social fu
7、nction, attempts to tear off the question which the Administrative Letters and Visits system has and the reasons which create the problems, comes up with the practical and feasible plans basing on it. It continues to play the proper role through its perfect improvement and entire social laws develop
8、ment. The text was divided into three parts basing on this: The first part is to basically explain the administrative letters and visits system as the premise studies of this article. First, in the is, the author comes up with his understanding of the Administrative Letters and Visits basing on comp
9、arative analysis for the related scholars to its concept limits foundation; Then the author divides it into six stages following the administrative letters and visits systems development; And then the author analyses the existence reason of administrative letters and visits system and thought that i
10、t has the social safety valves potential, have the solid government by law foundation, simultaneously conform to the cultural tradition; Finally, the author introduces the functions of the administrative letters and visits system. The second part analyses the present situation and existing main ques
11、tions of administrative letters and visits system. First, it introduces administrative letters and visits system basing on the frame which stipulates on “Inquiry Rule“; Then it points out the problems of administration letters and visits system in our country, such as the letters and visits accepts

13、dinated mechanism, the supervising of the letters and visits are not effective and so on, therefore we need to improve them and make them display its function in the correct track. The third part comes up with reasonable suggestion on the direction for the improvement of the Administrative Letters a
14、nd Visits system. First “Inquiry Rule“ had already provided the direction for our own improvement, therefore the author comes up with improvement ways for related systems including the hearing system, the responsibility investigated system, the letters and visits ended system, the leader reception d
15、ay system; Next, consummates promotion administration letters and visits system own development through the external environment, mainly including strengthens legislative, the conformity existing letter and visits resources, the promotion jurisdiction independence, the display function of society su
