1、沈阳师范大学硕士学位论文义务教育师资均衡的法律保障问题研究姓名：唐颢申请学位级别：硕士专业：教育经济与管理指导教师：郝淑华20090401I 义务教育师资均衡的法律保障问题研究 中 文 摘 要 教育的兴旺系于教师，保障义务教育阶段师资的相对均衡发展，为学生提供公平的受教育机会，这是关乎义务教育均衡发展的首要任务。而以法律高度来保障义务教育师资均衡发展，无疑是一种最公平、最有效的方式。新义务教育法的实施把义务教育师资均衡发展问题提升到法律高度加以规范，各个省市也出台了一系列相关措施，但就目前的发展现状来看，还是存在许多问题的，所以本文通过调查研究及分析，试图从法律运行的几个方面建构义务教育师资均
2、衡的法律保障体系，以期促进义务教育的均衡发展，早日实现义务教育公平的教学理念。 本研究采用文献研究法、调查研究法、比较法、案例研究法，从以下几个方面进行研究： 第一部分，引言。主要阐明本研究的缘起、研究目的、研究内容，研究意义、基本概念界定及相关问题的研究综述。 第二部分，义务教育师资均衡发展概述。首先对义务教育师资均衡发展的涵义和特性进行界定，重点探讨义务教育师资均衡发展的理论依据和原则 第三部分，义务教育师资均衡的法律保障现状分析。通过查阅相关资料及访谈相关人士，以辽宁省为例调查了其出台的相关法律、法规、政策文本及该省省会沈阳市的义务教育教师交流制度的实施情况，提出义务教育师资均衡的法律保
3、障存在的主要问题并分析其原因。 第四部分，义务教育师资均衡的法律保障体系的构建。首先介绍发达国家义务教育师资均衡法律保障的现状并总结其先进经验。根据法律运行理论，从立法， 执法等方面对义务教育师资均衡的法律保障体系进行重构。 最后， 在 “结束语”部分对全文的主要问题和基本观点进行概括和总结。 关键词： 义务教育，师资均衡，法律保障 IIIThe Research on Legal Protection of Balanced Teaching Resources for Compulsory Education Abstract The prosperity of education dep
4、ends on teachers. A top priority for the balanced development of teaching resources for compulsory education is to ensure the relatively balancing of teaching resources so that fair education opportunities can be provided to all students. Theres no doubt that the most equitable and effective way of
5、doing that is deemed to use legal procedure. In order to standardize the issue of balanced teaching resources for compulsory education, the new Compulsory Education Law is introduced and a series of actions are taken in many provinces and cities. However, several problems still remain unsolved viewi
6、ng current situation of compulsory education. Therefore, this research article analyses the reconstruction of legal protection system of balanced teaching resources during compulsory education period, which may improve the balanced development for compulsory education and carry out the ideality of f
7、air education as soon as possible. The research methods adopted in this article are literature review, survey questionnaire and case study methods. Section one gives an introduction, which illustrates the reason and purpose regarding the selection of this topic as well as the main content, significa
8、nce and basic definitions of the issue. Section two generalizes the issue of balanced teaching resources for compulsory education. The definition of the balanced development of teaching resources for compulsory education is given, focusing on the theoretical and IVprinciple basis of that. Section th
9、ree analyses the current situation on legal protection of balanced teaching resources for compulsory education. By means of searching related information and interviewing several experts, this section introduces the main problems of the present legal protection system and analyses the reason for tha
10、t, which takes Liaoning province as an example referring to its main regulations and policy on the balanced development of teaching resources for compulsory education and mentions Shenyang especially about the current situation on implementing the “teachers communicating system”. Section four is abo
11、ut the reconstruction of legal protection system of balanced teaching resources for compulsory education in China. It states the situation of legal protection system of balanced teaching resources for compulsory education in developed countries and summarizes their advanced experiences. According to
12、 the law running theory, this section analyses the reconstruction on legal protection system of balanced teaching resources for compulsory education from different perspectives of law-making and law-implementing. Finally, the conclusion section restates the main issues and perspectives of this resea
13、rch article while looking forward to further studies. 15、城乡间经济发展不均衡等多种原因，造成了不同区域间、城乡之间、同一区域内不同学校之间教育资源差异悬殊，办学设施和师资条件等都存在明显差别，“上好学”的问题逐步凸显。 “振兴教育的希望在教师” ，1保证同一区域内师资相对平衡，为学生提供公平的受教育机会，这是关乎义务教育均衡发展的首要任务。当下，全社会普遍倡导义务教育公平2、和谐发展，然而由于法律制度缺乏有效控制而造成的很多教师盲目、不合理的单向流动，越来越偏离和谐社会所倡导的义务教育公平的价值取向。 “法律是实现公平的一种最常见、最可靠的途径，在教育公平的实践中也发挥着越来越重要的作用。”3但我国由于历史等原因，正常的教育法制建设起步较晚，现行的
16、法律法规还不能满足教育法治化、保障义务教育均衡的需要，在教育立法、教育行政执法、教育司法等方面也存在很大的缺陷与不足，而义务教育的均衡发展，师资力量的均衡是最关键问题。因此，本文试以法律保障的视角来探讨义务教育师资均衡的问题，以期促进有关理论的深化和发展，对实践也有所裨益。 首先，从制度保障上讲， 2001年国务院关于基础教育改革与发展的决定提出建立“能进能出、能上能下”的教师任用新机制；2003年国务院关于进一步加强农村教育工作的决定提出要“建立城镇中小学教师到乡村任教服务期制度” ；2005年教育部关于进一步推进义务教育均衡发展的若干意见提出“要采取各种有效措施，建立区域内骨干教师巡回授课、紧缺专业教师流动教学、城镇教师到乡村学校任教服务期等项制度” ；2006年教育部关于大力推进城镇教1 李晓燕.我国教师的权利与义务及其实现教育保障机制研究M.广东教育出版社,2001.第 25 页. 2
