2、人们进一步深入地研究。 互联网技术的发展和信息全球化的趋势，使网络用户的规模迅速 扩大；而处于社会转型期间的诉求、意愿和矛盾也需要通过一定的渠 道表达出来。网络表达自由不仅可以释放社会结构中的不稳定因素， 而且给予社会发展一定的活力。世界上许多国家对于网络表达权投注 了较大的关注，通过宪法与相关法律法规的规定，使公民在运用网络 进行表达的过程中享有充分的自由权，不受他人或公权力的干预。近 年来，我国的法治建设有了长足的进步，但是对于网络表达权的研究 还较为落后，立法的发展相对也较慢，并且随着广大公民权利意识的 提高，我国的法律也暴露出许多问题。因此，为顺应世界人权的发展 趋势与公民基本权利保障
3、的需要，我国应加快对网络表达权的研究和 立法。 论文从法理学角度对网络表达权的概念与基本理论进行研究，旨 在对网络表达权的保护与规制的基本理念、基本原则以及基本制度的 建构方面进行理论分析，并通过对国内外网络表达权保护与规制的现 状和保护形式进行比较，探寻如何解决我国当前网络表达权保护与规 制所存在的不足之处，探索如何建立健全我国公民网络表达权的保护 与规制，保障、促进公民的网络表达自由的行使和实现，推进社会主 义人权保护事业的发展与深化。 我们认为，在现今信息化、人权化时代，人权保护已经成为社会 的主旋律，国家尊重和保护公民的人权，尊重和保护公民的人格、尊 严和权利，认真对待权利，成为法律的
4、内在灵魂和神圣使命。作为新 型人权，网络表达自由既与其他权利一样具有一般性、共同性，也有 自身的特质，彰显了民主、民权、民生的新的维度和机能。在当代中信息时代网络表达权的保护与规制 II国，我们应该以法治国家建设为基础，建设和完善富有中国特色的正 当的良性的法律制度，建设和完善正当的合理的合法的权利保护、救 济、规制机制及其运作机制，推进公民网络表达自由的保护和实现， 推动公民的自由、权利、利益的保障与发展。在当代中国，我们应该 通过观念更新、价值更新，通过制度创新和变革，通过法律实践的深 化，树立以人为本，人权至上，人民利益至上，正义、公平、公正、 民主、平等、自由等等价值理念，树立人文化、
5、人权化、法治化、民 主主义、平等主义、理性主义等等社会价值和精神取向，协调公民、 群体、社会、国家之间的关系，整合、协调、均衡各种利益关系，建 设、改进、发展富有民族特性、契合共同体需求、契合民意民生的网 络法律体系，建构与发展合理的公平的有效的网络法律保护、规制、 救济机制，规范公民网络表达权的行使和实现，充分地保护公民网络 表达的平等权利、平等自由，从而促进网络权利、网络表达权保护和 规制的制度化、法治化、人本化、民主化。 关键词：网络表达权，网络人权，言论自由，网络审查制度 中南民族大学硕士学位论文 IIIAbstract Following the books, newspapers,

As the network is being widely used, many new rights are presenting, the right of Network expression is one of them, as a new form of the r
7、ight to express, which is one of basic right of citizens, the Internet put forward new challenges to the traditional expression rights protection and regulations. Nowadays, respecting and safeguarding human rights have become not only the generally accepted value for various countries, but also the
8、direction which lead us to develop Chinas socialist society under the rule of law. While the emerging human rights- the right of Network expression, it is worth to further study the protection mode to realize its value and control method to limit the right. With Internet technology and information g
9、lobalization, the scale of network users has expanded rapidly; and in the social transition period, the appeal, will and contradiction will also need to be expressed through certain channels. Network freedom of expression not only can release the instability factors of social structure, but also giv
10、e certain vitality to social development. Many countries pay more attention for the right of Network expression, with the Constitution and relevant laws and regulations, their citizens enjoy full freedom to express when using the Internet and without intervention of another person or public authorit

In recent years, Chinas legal construction has made great progress, but the right of Network expression study also backwardly, the development of legislation is relatively slower, and with the general awareness of civil rights, our laws have exposed many problems. Therefore, in order to follow th

13、nce, in order to analysis theoretically the construction aspect of the basic concepts, basic principles and basic system of the right of Network expressions protection and regulation, and make compare domestic and international present situation and the protection form of the right of Network expres
14、sions protection and regulation to inquire about our countrys disadvantages, and at the same time, talk about some personal suggestions and views on that how to establish and improve our citizens the right of Network expressions protection and regulation. Through the study, it will provide not only
15、theoretical basis for the right of Network expressions legislation, but legislative ideas which want to make the right of Network expression detailed and constitutional, as well as provide system security of the right of Network expressions protection and regulation from two aspects-the public and p
16、rivate power, while with the system construction to settle emerging human rights issues caused by the conflict between abuse of state power and civil rights in the freedom of expression field. As far as we are concerned, the protection of human rights has become the zeitgeist of this informational and democratic era. Countries should respect and protect its citizens rights, and it is the inherent soul and sacred duty of law that it should keep a serious eye on the powe
