1、BHUMIBHOL ADULYADEJ, REXGiven on the 23rd day of March, B.E. 2543:Being the 55th year of the Present Reign.His Majesty king Bhumibhol Adulyadej is graciously pleased to proclaim that:Whereas it is expedient to revise the law on State Enterprise labor relations;Be it, therefore, enacted by the King,

2、by and with the advise and consent of the Parliament as follows:Section 1This Act may be cited as the State Enterprise Labor Relations Act B.E. 2543 (2000).Section 2This Act shall come into force as from the day following the date of its publication in the Government Gazette.Section 3The State Enter

3、prise Labor Relations Act B.E. 2534 shall be repealed.Section 4This Act is a law containing certain provisions relating to restrictions on liberty on dwelling place and restrictions onfreedom to unite and form as association, a union, a league, a cooperative, a farmer group, a private organization,

4、orany other group which issues by virtue of Sections 35 and 45 of the Constitution of the Kingdom of Thailand.Section 5This Act shall not apply to a State Enterprise as prescribed in the Royal Decree.Section 6In this Act.State Enterprise includes:(1) any government organization under the law on the

5、establishment of governmentorganizations or an enterprise of the State under the law establishing that enterprise,including business entities owned by the State; or(2) a limited company or registered partnership which a government ministry,department or equivalent public body or a state enterprise u

6、nder (1) has a share capital ofmore than fifty per cent.Employee means any person who agrees to work for an Employer in return for wages.Employer means any State enterprise agreeing to accept an Employee for work by paying him wages inreturn and includes a person authorized by a State Enterprise to

7、act on its behalf, or the person entrustedby the authorized person to act on behalf.Management means any individual who works for a State Enterprise at a management level, with theauthority to employ, dismiss, increase wages, cut wages, or reduce wages.Conditions of Employment include any rule conce

8、rning employment or working conditions, workingday and time, wages, welfare, termination of employment or other benefits of an Employer or anEmployee relating to employment or work.Agreement on Conditions of Employment means an agreement between an Employer and a LaborUnion under this Act.Labour Dis

9、pute means a dispute between an Employer and Employee in relation to Conditions ofEmployment.Lock-Out means any temporary refusal by an Employer to permit an Employee to work as a result of aLabor Dispute.Strike means any concerted stoppage of work whereby Employees act to slow down or delay theirwo

10、rk with a view to halting or delaying, in part or in whole, of the operation of a State Enterprise.Labour Union means a State Enterprise labor union established pursuant to this Act.Labour Federation means a State Enterprise labor federation established pursuant to this Act.Committee means the State

11、 Enterprise Labor Relations Committee.Registrar means the Director-General of the Department of Labor Protection and Welfare or a personso designated.Conciliation Officer means any person appointed as such by the Minister to carry out the execution ofthis Act.Competent Officer means any government o

12、fficer appointed by the Minister to carry on the executionof this Act.Minister means the Minister having charge and control over the execution of this Act.Section 7The Minister of Labor and Social Welfare shall have charge and control over the execution of this Act and retain thepower to appoint Con

13、ciliation Officer and Competent Officers to carry out the execution of this Act.The appointment under paragraph one of this Section shall be published in the Government Gazette.CHAPTER IThe State Enterprise Labor Relations CommitteeSection 8There shall be the establishment of Committee called The St

14、ate Enterprise Labor Relations Committee consisting ofthe Minister as its Chairman and the Permanent Secretary of the Ministry of Labor and Social Welfare, the SecretaryGeneral of the Office of the National Economic and Social Development Board, and the Comptroller General as itsmembers ex officio.

15、The other Committee members appointed by the Minister are five representatives of Employersand five representatives of Employees. The Director-General of the Department of Labor Protection and Welfare is aCommittee member and the Secretary of the Committee.Employer representative under paragraph one

16、 mean the governor, the Director, the managing director or a person inposition with similar authorization but otherwise named in the State Enterprise.Employer representatives under paragraph one mean person elected from among chairmen of State Enterprise LaborUnions.The election shall be conducted as so prescribed in the Ministerial Regulations published in the Government Gazette.Section 9The Committee members shall be appointed by the Minister for a term of
