3、全球化浪潮的背景下，得到了迅速发展。商会组织的迅速发展， 成为政府和企业之外的第三种力量， 它在提供政策咨询、加强行业自律、促进行业发展、维护企业合法权益等方面发挥了重要作用。与此同时，由于相关法律法规不健全，政策措施不配套，管理体制不完善，商会组织存在着结构不合理、作用不突出、行为不规范等问题。出于实际的需要，迫切需要对商会组织进行监管。较之同行监督、媒体监督、第三方评估等外部监管方式，政府监管是目前最为成熟、最为有力的方式。然而，实践中地方政府对商会组织监管的效果并不乐观，存在着政府监管理念滞后、商会组织政治化色彩浓厚、双重管理体制不合理、监管法律法规不完善等等问题。因此，研究地方政府应如
4、何对商会组织进行有效的监管，我国地方政府应构建怎样一个监管机制，如何改善商会组织的监管困境，是一个值得研究的课题。研究这个课题对于提高政府监管效率，促进商会组织的发展也具有一定的理论意义和现实意义。 本文选取地方政府对商会组织监管为研究对象，既立足于中国实际，又借鉴西方发达国家政府监管经验。本文阐述了商会组织的发展历程、商会组织发展现状、地方政府与商会发展之间的关系，分析了地方政府对商会组织监管的现状及问题。结合当地实际，借鉴西方国家监管商会组织的经验，提出了完善地方政府对商会组织监管的对策措施，即树立有效的监管2理念、理顺地方政府与商会组织之间的关系、摒弃双重管理体制、完善监管法律法规、建立
5、商会的评价惩罚体系和淘汰机制等，进一步加强对商会组织的监管。本文研究的目的主要是充分发挥商会组织在区域经济发展中的积极作用，进一步规范地方政府对商会组织的监督和管理，切实加强地方政府对商会组织发展的指导，为地方政府如何更好地监管商会、推进商会的改革和发展提供切实可行的框架与相应的配套政策措施，更好地促进区域经济的发展。 关键词：地方政府，商会组织，监管 3A RESEARCH ON THE ORGANIZATIONAL REGULATIONS OF COMMERCIAL CHAMBER OF LOCAL GOVERNMENT ABSTRACT As one kind of nonprofit
6、organizations, the organization of commercial chamber (including trade association and chamber of commerce) has made rapid progress under the background of globalization and the development of socialist market economy. It has grown up as the third party beyond government and enterprises and has play
7、ed an important role in policy consultation, self-discipline and development as well as safeguarding the interests and rights of the enterprises. Meanwhile, since relevant laws and statutes are faulty, policies and measures have not been well coordinated with each other, management system is not eff
8、ective, the chamber of commerce in organization structure is unreasonable, the effect is not good, and behavior does not standardize. Comparing with the external supervision measures such as trade supervision, media supervision and the third party supervision, government supervision is so far the mo
9、st mature and powerful way. However, the effects of government supervision in practice were no so desirable. Problems were mainly about the lagging management concept of the government, the politicization color of the chamber of commerce, the irrational system of dual command and the imperfect of su
10、pervision legislation. So it is worthy researching to make 4effective supervision over the chamber of commence, to establish supervision mechanism and to get out of the dilemma of organization supervision. The issue also has great theoretical and practical significance in improving supervision effic
11、iency and the development of chamber of commerce. The paper takes chamber of commence under the government supervision as the object of study, not only having a foothold on Chinas reality, but also learning the experiences from western countries. It discusses the developmental course and the current
12、 state of the chamber of commerce, the relations between the local government and the chamber of commerce, and the problems of local governments supervision of chamber of commerce. It has proposed some policies to improve local governance, including overseeing the chamber of commerce, reinforcing su
13、pervision and control of organization of chamber of commerce further by setting up effective overseeing idea, rationalizing the relation between the local government and organization of chamber of commerce, getting rid of double management system, perfecting the valuation overseeing laws and statute
14、s , founding a chamber of commerce and so on, reinforces supervision and control of organization of chamber of commerce further. The goals of the issue are to bring the positive effect of chamber of commerce into play in district economy, further regulate the management of chamber of commence and st
15、rengthen the guidance of local government. The paper tries to provide feasible framework and relative policy to improve the supervision, push forward the reform of commercial chamber and promote the development of local economy. 16、ision 7第一章 绪 论 本章节论述论文选题的背景和意义，国内外相关内容研究的现状与不足，此外也说明本研究的理论基础、研究思路、方法、意义及创新点。 第一节 论文选题背景和意义 研究公民社会和非营利组织的著名学者莱斯特M萨拉蒙认为:“如果说代议制政府是 18 世纪的伟大社会发明，而官僚政治是 19 世纪的伟大发明，那么，可以说，有组织的私人自愿性活动， 亦即大量的公民社会组织代表了 20 世纪最伟大的社会创新1。 ”随着治理理论的兴起，国内外学者掀起了对非营利组织的研究的热潮。而商会组织作为非营利组织的一种形式，与政府和企业联系紧密，日益受到政治学、经济学和社会学学者的关注。 一、论文选题的背景 在我国，严格意义上的现代商会组织出现于上个世纪 90 年代，是在政府行政体制改革的大背景下产生的。我国的商会组织才刚起步，主要有自上而下型商会和自下而上型商会两种表现形式，也有学者将其概括为体制内和体制外两种产生途径。当前，面对国内经济政治体制的转变和来自国外的种种理论观念，商会的发展
