5、e Rules are formulated in accordance with the Customs Law of the Peoples Republic of China (hereinafter referred to as the Customs Law), the Regulations of the Peoples Republic of China on Import and Export Duties (hereinafter referred to as the Regulations on Duties) and other relevant laws and adm
6、inistrative regulations with a view to standardizing the commodity classification of import and export goods and ensuring the accuracy and uniformity of commodity classification.第 一 条 为 了 规 范 进 出 口 货 物 的 商 品 归 类 ， 保 证 商 品 归 类 结 果 的 准 确 性 和 统 一 性 ， 根 据 中华 人 民 共 和 国 海 关 法 （ 以 下 简 称 海 关 法 ） 、 中 华 人 民 共
7、 和 国 进 出 口 关 税 条 例 （ 以下 简 称 关 税 条 例 ） 及 其 他 有 关 法 律 、 行 政 法 规 的 规 定 ， 制 定 本 规 定 。Article 2 The term “commodity classification” as referred to in these Rules means the activities of determining the commodity codes of import and export goods, on the basis of the Customs Import and Export Tariff of the
8、 Peoples Republic of China, the Explanatory Notes to Commodities and Their Headings in the Customs Import and Export Tariff, the Explanatory Notes to the National Subheadings of the Customs Import and Export Tariff of the Peoples Republic of China, and the administrative rulings and decisions on com
9、modity classification issued by the General Administration of Customs, under the commodity nomenclature of the International Convention on the Harmonized Commodity Description and Coding System.第 二 条 本 规 定 所 称 的 商 品 归 类 是 指 在 商 品 名 称 及 编 码 协 调 制 度 公 约 商 品 分 类 目 录 体 系下 ， 以 中 华 人 民 共 和 国 进 出 口 税 则 为 基
10、 础 ， 按 照 进 出 口 税 则 商 品 及 品 目 注 释 、 中华 人 民 共 和 国 进 出 口 税 则 本 国 子 目 注 释 以 及 海 关 总 署 发 布 的 关 于 商 品 归 类 的 行 政 裁 定 、 商品 归 类 决 定 的 要 求 ， 确 定 进 出 口 货 物 商 品 编 码 的 活 动 。Article 3 These Rules apply to the commodity classification by the consignee and the consignor of import and export goods and the agent ther
11、eof (hereinafter referred to as the consignee, consignor, or the agent thereof), and to Customs examination and verification, in accordance with law, of commodity classification.第 三 条 进 出 口 货 物 收 发 货 人 或 者 其 代 理 人 （ 以 下 简 称 收 发 货 人 或 者 其 代 理 人 ） 对 进 出 口货 物进 行 商 品 归 类 ， 以 及 海 关 依 法 审 核 确 定 商 品 归 类 ，
12、适 用 本 规 定 。Article 4 The commodity classification of import and export goods shall follow the principles of objectiveness, accuracy and uniformity.第 四 条 进 出 口 货 物 的 商 品 归 类 应 当 遵 循 客 观 、 准 确 、 统 一 的 原 则 。Article 5 The commodity classification of import and export goods shall be determined in accorda
13、nce with the actual conditions of the goods when they are declared by the consignee, consignor or the agent thereof. The commodity classification of import and export goods declared in advance before arrival shall be determined in light of the their actual conditions when they arrive at Customs cont
14、rol premises. Where it is otherwise prescribed in the provisions of any law, administrative regulation, or any rule formulated by the General Administration of Customs, those provisions shall prevail.第 五 条 进 出 口 货 物 的 商 品 归 类 应 当 按 照 收 发 货 人 或 者 其 代 理 人 向 海 关 申 报 时 货 物 的 实 际状 态确 定 。 以 提 前 申 报 方 式 进
15、出 口 的 货 物 ， 商 品 归 类 应 当 按 照 货 物 运 抵 海 关 监 管 场 所 时 的实 际 状 态确 定 。 法 律 、 行 政 法 规 和 海 关 总 署 规 章 另 有 规 定 的 ， 按 照 有 关 规 定 办 理 。Article 6 The consignee, consignor or the agent thereof shall, in accordance with the provisions of relevant laws and administrative regulations as well as the requirements by Cus
16、toms, make a faithful and accurate declaration of the commodity name, specification, model, etc. of its import or export goods, and classify the import or export goods declared by it by giving the goods the corresponding commodity codes.第 六 条 收 发 货 人 或 者 其 代 理 人 应 当 按 照 法 律 、 行 政 法 规 规 定 以 及 海 关 要 求 如 实 、 准 确 申报 其进 出 口 货 物 的 商 品 名 称 、 规 格 型 号 等 ， 并 且 对 其 申 报 的 进 出 口 货 物 进 行 商 品 归 类 ， 确定 相 应 的商 品 编 码 。Article 7 Where multiple im
