1、摘 要1摘 要在现代社会，伴随经济发展与技术进步而来的道路交通事故，对人民群众的人身安全造成极大的威胁，道路交通事故已成为严重的社会问题。基于此，对受害人进行及时有效的救济，妥善解决当事人之间的纠纷对维护社会的稳定和谐具有重要的意义。因此，我们有必要对道路交通事故人身损害赔偿问题进行深入研究。本文在结构上分为引言、本论和结论，其中本论部分共五个部分：第一部分为交通事故人身损害赔偿制度概述。本部分主要论述了道路交通事故的概念和道路交通事故人身损害赔偿的概念及构成要件。第二部分为道路交通事故人身损害赔偿归责原则。本部分共两个方面，一是论述了各国有关道路交通事故损害赔偿的归责原则；二是论述了我国道路
2、交通事故人身损害赔偿的归责原则。第三部分为道路交通事故人身损害赔偿责任主体的认定。本部分首先论述了赔偿责任主体的相关概念；其次论述了确定赔偿责任主体的一般标准；最后论述了机动车所有者与使用者分离的情形下确定赔偿责任主体的问题。第四部分为道路交通事故人身损害赔偿的范围和标准。本部分主要从道路交通事故人身损害赔偿的范围和道路交通事故人身损害赔偿的标准两方面进行论述。第五部分为完善我国道路交通事故人身损害赔偿制度的几点建议。本部分从完善机动车强制险制度、完善社会保障救助制度和完善立法三方面提出几点完善制度的建议。关键词：道路交通事故 人身损害赔偿 归责原则 赔偿责任主体 赔偿范围和标准 制度完善AB
