3、重要的地位。海洋约占地球表面 70.8%，蕴藏着非常丰富的资源并且为全球的交流运输提供了相当大的便捷，这吸引了世界各国对于海洋开发利用的力度加大，然而人类对于海洋的过度利用影响了海洋和其复杂的海洋生态系统。建立海洋保护区，可以保护所有海洋生物免于各种形式的捕捞或其他提取活动的区域，恢复其生态系统。由于专属经济区制度使很多远洋渔船转移到公海，对公海渔业资源和生态系统的破坏也就随之而来，因此需要在公海上建立海洋保护区。而在公海建立海洋保护区又会牵扯到“公海自由”以及各国的经济利益、法律制度等问题，需要更为复杂的国际法依据或者其他有效手段的支持才能进行。本文通过对海洋保护区的概念、相关国际文件及相关

About 70.8%of the surface on the earth is ocean, which has rich res
5、ources and has provide the considerable convenience of transportation and communication to the whole world. This has attracted worlds efforts to increase the exploitation of the marine resources. However, the excessive use of marine resources has impacted on marine and its ecosystem. To establish Ma
6、rine Protected Areas can protect all marine living resources from all forms of fishing or other activities in an specific area and can recover its damaged ecosystem. Owing to the regime of Exclusive Economic Zone, a lot of offshore fishing vessels has transferred to the High Seas, and following with
7、 the damage to the fishing resources and its ecosystem on the High Seas. Therefore, there is necessity to establish the Marine Protected Areas on the High Seas. However, the establishment of Marine Protected Areas on the High Seas involves of the freedom of High Seas and economic benefits of all cou

10、，海洋就开始为人们所用，并越来越体现出其重要的交通作用，海事海商业的发展引领了全球贸易往来的不断增进以及经济的飞速运转。然而，这些海洋活动的附属效应也导致海洋生物多样性和海洋环境面临了严峻的挑战: 沿海城市的污水直接排向海洋; 陆地地表径流中的淡水携带着大量金属和有机污染物流向海洋; 海洋石油开采过程中的各类溢漏情形; 海上倾废所导致的大气污染；渔业的过度捕捞以及海水养殖业的无序管理等等。面对海洋环境的严重污染，海洋资源过度地开发利用，所导致海洋环境及其资源的严重破坏，近 30 年来，世界各国，特别是不少沿海国家和地区相继建立起为数众多的各种类型的海洋保护区。通过海洋保护区的建立能完整地保存自然
