2、 valid from (Y/M/D) until (Y/M/D) or terminated by either party二、工作职责和上班时间 Responsibility & working hours1. 招标方聘用承包方出任 单位 职位,详细职务说明书。Party Bs Department: Party Bs position:Please refer to the job description for details.2. 承包方须进行招标方分配的生产制造(工作中)每日任务Party B must accomplish his/her regular work and add
3、itional assignments on time3. 每日工作中8钟头，每星期工作中共40钟头。There are 8 working hours a day, 40 working hours a week.4. 招标方如因业务拓展转变 必须对承包方的岗位及工作中地区开展调节，承包方理应接纳。如因招标方公司业务拓展必须或企业合并公司分立等变动，承包方愿意依照法律法规持续此合同书，并接纳招标方分配，在_(某地域)工作中。If Party A needed to adjust Party Bs position and working area for business developme
4、nt variety, Party B should accept it.三、薪水 Salary承包方每月的标准工资：RMB 绩效考核工资：RMB 综合性救济金：RMB ，职工薪酬为RMB 元(该额度并未扣减税费、住宅花费及其社保中本人应交的部分)，另招标方给予承包方职工薪酬7%的公积金(如法律法规公积金缴费数量有限制，则按照政策法规实行)。实习期满，经考评后,依据考评結果明确是不是宣布录取，宣布录取后薪酬维持不会改变。招标方将视企业的赢利状况和承包方的考评結果，于每一年的三月份开展薪酬调节。Party Bs monthly total revenue (before the deductio

7、th.五、请求超时工作中 Over Time承包方应专注于提升工作效能，准时进行生产制造、工作目标。如因特殊情况必须加班加点，可自行安置。如承包方期待根据自行安置加班加点获得加班工资，则承包方务必在加班加点前四钟头填好加班申请表呈经理审核。不然，视作失效加班加点，详细员工手册。Party B must try his best to increase the working efficiency to meet Party As requirement. If there are special circumstances that Party B has to work overtime,
8、Party B can arrange by themselves. If Party B requests OT payment, he/she must fill in the OT application form and have it approved by GM. OT Application Form without authorized signature is not valid.六、加班工资 OT Compensation承包方经招标方准许在工作中日加班加点，招标方务必付款给承包方标准工资150%的酬劳;歇息日被分配工作中而招标方又不能够给与承包方同样時间的调休，则招标方须
9、付款给承包方标准工资200%的酬劳;若在国家法定请假日被分配工作中,招标方交给承包方标准工资300%的酬劳。If Party B works over time and has approved by Party A, he/she will be offered the same period of compensation leave or OT salary according to Labor Law of PRC China.七、暑假与褔利 Holiday & Benefits1. 有薪国家法定假日 Statutory Holiday of PRC China with pay2.
10、有薪法定婚假/生育假/丧假 Leave for Marriage, Maternity and Mourning with pay.3. 有薪婚假 Annual leave with pay4. 社保 Social Insurance5. 本年度奖励金Annual bonus (based on the months worked with party A at the rate of one months wage for each full year worked. )敬请参考员工手册Please refer to Party As employee manual for detail i
11、nfo.八、工作纪律 Discipline承包方应严格执行招标方制订的各类管理制度和工作纪律(详请请参考员工手册实行)Party B shall strictly obey Party A regulations and discipline. Please refer to Party As employee manual.九、保密协议 Confidentiality承包方需严苛传统工作中全过程中触碰和掌握到的企业商业机密(包含生产制造方法、生产流程、商业秘密、管理方案、产供销对策、一手货源情报信息、设计图、成本费价钱和客户数据)，不然将遭受行政许可(如没有理由辞退、赔付等);违犯刑诉法的，
12、招标方将有权利转交司法部门解决。承包方调职招标方，应获得招标方愿意，并将全部商业机密材料转交招标方，另外担负不向外泄漏的责任，并确保大半年内不可运用招标方商业机密在生产制造类似且与招标方有竞争关系的商品的别的公司内就职。不然，招标方有权利规定承包方赔付因而而产生的一切财产损失。The recipient shall undertake the obligation to keep confidential, in accordance with the scope and duration agreed upon by both parties, the technical secrets c
13、ontained in the technology provided by the supplier, which have not been made public.十、终止合同 Termination1. 停止合同规定标准 Termination conditionsA. 使用期内，彼此皆可及时通告另一方消除合同规定;During the probation period, either side can terminate the contract by immediate effect.B. 实习期满时，任何一方欲终止合同，须提早三十日以书面通知通告另一方。不然，违约方须向守约方付款
14、合同违约金(合同违约金为承包方一个月的薪水)，若导致守约方财产损失的，应依规担负承担责任。Either side can terminate the contract by giving 30 days notice in written form after probation period.2. 招标方在以下状况下可随时随地立即地通告承包方消除合同规定，不必执行一切法定义务和办理手续，不必向承包方赔偿If any case of the following circumstances, Party A has the right to inform Party B rescission o
15、f the contract：A. 承包方在使用期内达不上招标方的规定;Party Bs performance cant meet Party As requirement.B. 承包方比较严重渎职，给招标方权益导致巨大损失的;The other party has breached the contract, to the extent that such breach has seriously affected the economic benefits expected when concluding the contractC. 违背招标方相关要求，应予以辞退的，敬请参考员工手册实行。The condition agreed on in the Party As employee manual for rescission of the contract has arisen3. 承包方在以下状况下停止合同规定不应向招标方赔偿If any one of the following circumstances,
