11、按约定备好货物和提供装卸条件，以及货物运达后无人收货或拒绝收货，造成承运人车辆放空、延滞及其他损失的，托运人应负赔偿责任。2托运人不如实填写运单，错报、误填、遗漏货物名称、装卸地点等重要情况，造成承运人错送、装货落空以及由此引起的其他损失，托运人应负赔偿责任。3承运人应根据承运货物的需要，按货物的不同特性，提供技术状况良好、经济适用的车辆，并能满足所运货物重量的要求。4托运人有权决定货物是否保险或保价。货物保险由托运人向保险公司投保或委托承运人代办。选择保价运输时，申报的货物价值不得超过货物本身的实际价值；保价为全程保价，保价费按不超过货物保价金额的0.7%收取。一张运单托运的全部货物只能选择

12、保价或不保价。5货物运输需要办理审批、检验手续的，托运人应将办理完有关手续的文件提交承运人并随货同行。托运人委托承运人向收货人代递有关文件时，应在运单中注明文件名称和份数。二、包装1托运人应按约定包装货物。托运人未按约定包装货物，不能保证货物运输安全的，承运方有权拒绝承运。约定由承运人对货物再加外包装时，包装费用由托运人支付。2由于托运人的包装缺陷产生破损，致使其他货物或运输工具、机械设备被污染腐蚀、损坏或造成人身伤亡的，托运人应负赔偿责任。由承运人按约定对货物再加外包装的，发生上述问题，承运人应负赔偿责任。三、运送1承运人应在约定期限内将货物运到指定的地点，并在小时内以合理方式向收货人发出到

13、货通知或按托运人的指示及时将货物交给收货人。承运人如将货物错运到货地点或收货人，应再次无偿运至约定的到货地点或收货人。2承运人应对货物的安全负责，保证货物无短缺，无人为损坏，无人为因素导致的变质。3起运前运输路线发生变化承运人应通知托运人，并按最后确定的路线运输。承运人未按约定路线运输而增加的运输费用自行承担。4承运人有权向托运人、收货人收取约定的运杂费用。托运人或者收货人未按约定支付运杂费、保管费以及其他运输费用的，承运人对相应货物享有留置权。5承运人未遵守约定的运输条件或其他约定事项，应赔偿托运人由此受到的损失。6承运人未经托运人同意，擅自将货物委托其他公司运输的，应赔偿托运人因此受到的损

14、失。7在承运人将货物交付收货人之前，托运人可以要求承运人中止运输、返还货物、变更到达地或者将货物交给其他收货人，但应赔偿承运人因此受到的损失。四、交货1货物交接时，一方对货物的重量和内容有质疑，可提出查验与复磅，查验和复磅的费用由责任方负担。2收货人不明或收货人拒绝受领货物的，承运人应及时与托运人联系，在规定期限内负责保管并有权收取保管费用，对于超过规定期限仍无法交付的货物，承运人有权按中华人民共和国合同法的规定，提存货物。3货物有包装的，到达运输地点后，外包装完好而内部货物有货损、货差的，由托运人负责。五、事故处理1货运事故是指货物运输过程中发生货物毁损或灭失。货运事故发生后，承、托双方应编

15、制货运事故记录。2货物运输途中，因第三方责任造成货物毁损或灭失的，承运人应先行向托运人赔偿，再由其向第三方追偿。货物已投保的，承运人应不迟延的通知托运人，并采取一切方便协助托运人获得赔付。若承运人怠于履行通知义务和协助义务，应赔偿托运人因此受到的损失。3承运人能够证明是由于合同法第311条规定的原因造成货物毁损、灭失的，不承担损害赔偿责任。4货运事故处理过程中，收货人不得扣留车辆，承运人不得扣留货物。由于扣留车、货而造成的损失，由扣留方负赔偿责任。六、争议解决本合同项下发生的争议，双方应协商或申请调解解决，协商、调解解决不成的，可向有管辖权的人民法院起诉或向双方选定的仲裁机构仲裁。北京市工商行政管理局北京市运输管理局制定 5 / 5
