5、于人的差异性的正义和基于人的同一性的正义，二者各具不同的基础，互不排斥，同时并存，共同构成正义的具体内容；对等是实现正义所必须遵循的原则，从人的同一性出发，通过对等原则而实现同等对待，从人的差异性出发，通过对等原则而实现差等对待，对等包括质的对等和量的对等，其中任何方面的缺失或不对等都会阻碍正义的实现，对等虽然在正义的生成过程中起着不可替代的作用，但正义生成的根源却并不在对等而在于人之差异与同一，于是正义的问题就转化为人之差异与同一自身存在是否具有合理性的问题，当然对等的产生也有一个复杂的过程，有其自然的基础，也有其社会的基础；人类社会的历史表现为从同一走向差异的历程，同时也表现为从差异走向同
6、一的进展，这其实是差异性正义和同一性正义分工协同的发展，差异性正义和同一性正义是任何一个正义的社会都不可或缺的，它们相互联系、相互斗争，共同推动人类社会向前发展，虽然差异性正义和同一性正义都在适合自身特性的领域发挥优势，但现实生活中同一总是对差异的无限膨胀进行抵制，具体表现为对贫富差距继续扩大的阻止，争取经济和社会的平等，而差异总是向同一的场所渗透，表现为实际上的人权的不平等。主题词：正义，差异，同一，对等，互动第 i 页AbstractAbstractJustice is only the justice on human being，Human being is the unity of
