1、单一颜色论文：单一颜色商标的法律保护问题研究【中文摘要】颜色商标分为颜色组合商标和单一颜色商标。单一颜色商标的注册问题一直是人们关注的话题。单一颜色商标在美国、德国、法国、我国台湾地区、意大利、韩国等国家和地区已经获准注册。而我国商标法仍只将颜色组合商标纳入保护范围,单一颜色商标被排除在外,这与世界各国加强非传统商标保护的国际形势背道而驰。因此,商标法的修改完善,保护单一颜色商标成为一件十分紧迫的任务。本文除导言和结论外共分成四章:第一章探讨了单一颜色注册为商标的可能性和必要性。肯定单一颜色的保护,首先必须肯定单一颜色成为商标是可能的,并且是必要的。本章驳斥了反对单一颜色商标注册的三个理论,分
2、析单一颜色商标注册的可能性,然后列举了美国、德国、欧盟三个国家或地区的立法例和注册实例,最后分析了单一颜色商标注册的必要性。阐明单一颜色是可以注册为商标的,为全文内容的展开做出相应的铺垫。第二章分析了单一颜色商标保护的基本要件。探究单一颜色商标得到商标法保护的基本要件:显著性和非功能性。第三章研究单一颜色商标的申请和审查。仅仅从理论上论述单一颜色注册的可能性和必要性,并不足以唤起人们对单一颜色商标保护的注意,因此,本章从实践的角度论述了单一颜色商标保护的可能性和必要性:单一颜色商标在实践中是可行的。第四章论述了单一颜色商标保护的建议。既然单一颜色商标无论在理论上还是在实践中都是可能的并必要的,
3、那么我国就有必要对单一颜色商标进行保护。本章结合我国商标法的现状就单一颜色商标保护提出修改商标法的建议,建议成立专门机构,实行专家参审制度,建议加强对商标审查人员和商标审理法官的培训,提高商标审查人员和审理法官素质,来保护单一颜色商标。【英文摘要】Color marks can be divided into a single color and color combination trademarks. Single color trademark registration issue has been the subject of attention. Single color trade
4、mark in the United States, Germany, France, Taiwan, Italy, Korea and other countries and regions has been allowed to register. But our country still only protects color combination trademarks Single color marks are excluded, Therefore, revising Trademark Law and protecting a single color marks is a

Exploring that a single color marks should be have the basic elements: significant and non-functional.Chapter III studies the application and review of a single color trademark. Only the discussion of the possibility
8、 and necessity of registration of the single color theoretically, is not sufficient to evoke the attention of a single color trademark protection.Therefore, this chapter studies the possibility and necessity of a single color trademark protection from a practical point of vie: Single color trademark
9、 is feasibleand can be operated in practice.Chapter IV discusses the recommendations of a single color trademark protection.Since a single color marks both in theory and in practice are possible and necessary, protecting a single color trademark is necessary.This chapter proposes the advice to amend
10、 trademark law. The establishment of specialized agencies, and the implementation of expert system involved in a trial are necessary.
