1、.本科毕业论文浅析共犯关系之脱离丁震锋201030840309指导教师 刘美彤 讲师学院名称人文与法学学院 专业名称法学论文提交日期2014年04月 论文答辩日期2014年05月摘 要共犯关系脱离的概念是由日本学者大塚仁教授首先提出来的，最初是为了弥补共犯中止的不足。如今，共犯脱离问题在各国有了独立研究价值，我国在此问题的理论研究上有所落后，司法实践中也没有统一的判断标准。笔者希望能通过对共犯脱离问题进行一系列的探讨，以期丰富刑法理论中关于共犯脱离理论的研究。本文共分为前言、正文和结语三个部分。前言部分通过一个案例来引出共犯关系脱离这一概念，简单介绍了理论界对共犯关系脱离的研究现状，并指出本文
2、的写作目的。正文部分是本文的主体，共分三部分来进行阐述。第一部分共犯脱离的基本理论，是本文的基础章节，通过对共犯中止的概念来引出共犯脱离的概念，同时对于目前共犯关系脱离的学说流派做了简要的介绍和分析。目的在于加强对于共犯脱离概念的理解，以期能为后面的内容提供更好的理论基础。第二部分共犯脱离与共犯中止的关系，这一部分分别对共犯脱离与共犯中止的联系和区别进行了分析和探讨。第三部分共犯脱离在我国的适用，分为两个部分：共犯脱离的成立条件、具体共犯脱离的类型，主要针对共犯脱离制度在我国的适用进行了简要的分析以及一些粗浅的建议。结语部分是对本文的基本观点进行了概括性的总结。关键词：共犯脱离 共犯中止 在中

The aim of creating such a concept was
4、to make up the deficiencies of discontinuance of complicity. Nowadays, research on the problem of departing from complicities gains independent research value in various countries. Our theoretical study on this question is lagging. There is no uniform estimate standard in judicial practices. The aut
5、hor hopes to explore series problems of the departing from the complicity, in order to enrich the theoretical research about the departing from the complicity in the criminal law theory. The dissertation consists of three parts, which are foreword, text and epilogue. The foreword leads to the concep
6、t of departing form complicity theory through a case. It briefly describes the research status of departing form complicity theory, and points out the purpose of writing this dissertation. The text part divided into three parts is the main body of this paper.The first part is about the basic theory
7、of departing from complicity, is the basic section of this paper. This section discusses the concept of discontinuance of complicity, which leads to the concept of departing from complicity. The purpose is to enhance the understanding of departing from complicity, in order to provide a better theore

This section discusses and analyzes the links and differences between departing from complicity and discontinuance of complicity. The third part is abou

This section is divided into two parts: the establishment of conditions of departing from complicity, the different types of departing from complicity. This section briefly provided some analysis focused on the application of departing from co

12、日，张三、李四、王五一同去观看周妹伦演唱会，在会场见一美丽女士甲坐在他们隔壁，三人遂心生歹意欲共同强奸甲。经三人商量之后，于演唱会结束后一路尾随甲女士，至无人之处，三人强行将甲拖至一阴暗角落。三人商量由张三先行对甲实施强奸行为，甲拼命挣扎并求饶。李四见甲可怜，心生悔意便劝张三放过甲，百般劝说但张三没有理睬。李四见状，十分无奈，然后独自转身离去。之后张三实施了行为。王五见李四离开，自己感觉这种行为很脏。也放弃了强奸，然后与李四一起离开。在本案中，张三、李四、王五基于共同的强奸犯意与共同的犯罪行为，可认定为共犯关系。但是，李四在中途心生悔意，劝说欲继续实施强奸行为的张三失败，最终没有成功阻止犯罪结果的发生，根据我国刑法第 24 条的规定：“在犯罪过程中，自动放弃犯罪或者自动有效地防止犯罪结果发生的，是犯罪中止。”，李四的行为不具有有效性，即不符合犯
