RECITALS鉴于甲方愿意录用乙方，乙方愿意到甲方工作，按照中华人民共和国劳动法、中华人民共和国劳动合同法和上海市劳动和同条例等我国国家和地方政府的有关法律法规和行政规章，以及甲方制定的各项规章制度，本着平等、自愿的原则，经甲、乙双方协商一致，特签订本劳动合同（以下简称“本合同”）。WHEREAS, Party A intends to employ Party B and Party B intends to work for Party A,In accordance with Labour Law of the P

Terms and Conditions第一条（合同类型与期限）Article 1 Type and Validity Term of Agreement（一） 本合同为有 无 固定期限的劳动合同，合同期从年月日起，至年月日止。其中试用期为个月，自年月日起至年月日止。1.1 This Agr
5、eement is an employment contract with fixed-term or uncertain term; the validity term of this Agreement commences on the date of (), and expires on the date of (), including a probation of () months from the date of () to the date of ().（二） 乙方应于本合同签订后，在年月日前到岗位工作。1.2 Party B shall, after execution of
6、 this Agreement, work at the designated position on or before the date of ().第二条（工作内容和工作地点）Article 2 Description of Work and Work Site（一）根据甲方需要，乙方在部门从事 岗位工作，乙方到岗后应服从所属部门或上级主管的工作安排。2.1 On the basis of Party As requirements, Party B is to work at the position of () in the division of (); Party B shall
7、 be subject to the work arrangement made by the division he or she works in or the director at higher level.（二）乙方应履行甲方制定的岗位职责，按时、按质、按量完成其本职工作。2.2 Party B shall perform his or her work duties provided by Party A, and shall complete his or her work task in accordance with the provisions in terms of ti
8、me limit, quality and workload.（三）乙方承诺，愿服从甲方根据工作需要、乙方工作能力及其表现而安排或调动的工作岗位。并同意在下列情况下本合同不作变更处理。2.3 Party undertakes to accept the arrangement or change of work made by Party A in light of Party As work requirements and Party Bs working ability and performance; Party B agrees that this Agreement may not
9、 be altered under any of the following circumstances:1、乙方的工作地点由所在部门安排。今后因工作需要乙方在甲方所在本市的全部经营办公场所及附属场所（包括公司自有产权的物业或租赁的物业，）之间调整时。1. Party Bs working site is to be arranged by the division he or she works in; Party A is to change Party Bs working site within all its business offices and attached sites i
10、n the city where Party A is domiciled (including Party As own property or other premises leased by Party A), on the basis of Party As working requirement;2、甲方因工作需要，临时指派乙方到境内外短期出差地点工作的。2. Party A assigns Party B to work at home or abroad on business travel for a short term on the basis of Party As wo
11、rking requirement.3、甲方因工作需要，安排乙方临时外借到其它部门或其它他单位工作的。3. In response to working requirement, Party A temporarily assigns Party B to work at other divisions of Party A or other entities.（四）因工作需要，乙方被指派到外省市或境外企业或机构长期工作的，协商一致后，本合同作变更处理。2.4 Where, in response to working requirement, Party A assigns Party B
12、to work in enterprises or organizations located in other provinces or municipalities or abroad for long period, this Agreement may be altered on the basis of mutual consent through negotiation第三条（工作时间和休息休假）Article 3 Working Hours and Holiday（一）乙方的岗位实行全日制标准工时工作制度，甲方安排乙方每日工作时间不超过8小时，每周工作五天。3.1 Party B
13、 is to work under the full-time standard working time system: Party A may require Party B to work for no more than 8 hours every day and for five days every week.（二）甲方由于工作需要，经与乙方协商后可以延长工作时间，一般每日不超过1小时，因特殊原因需要延长工作时间的，在保障乙方身体健康的前提下工作时间不得超过3小时，每月不得超过36小时。3.2 If necessary for work, Party A may, on the b
14、asis of negotiation with Party B, extend Party Bs working hours for no more than one hour every day generally; where it is necessary to extend working hours under special circumstances, such extension of working hours may not exceed three hours every day on the premise of being no harmful to Party Bs health, and no more than a total of 36 hours every month. （三）乙方有享受国家规定的各类休息休假的权利，具体按甲方的职工工作时间及休息休假管理办法执行。3.3 Party B is entitled to all the holidays and leaves provided by the State, to which the Implementation Rules for Employees Working Hours and Holiday
