2、大学制度伦理进行深入探讨，并针对中国高等教育现代化转型过程中 凸显的大学制度伦理危机进行批判和反思，具有重要的学理价值和现实意义。 大学制度伦理是对大学制度的合理性要求，即是根据一定原则和标准对大学制 度的价值取向进行伦理评价。在大学制度伦理多元复杂的评价标准中，公正是首要 的评价标准，学术发展是根本性的评价标准。大学制度伦理包括实质伦理、形式伦 理和主体伦理三个部分，三者相互依赖、相互制约、密切相关，共同构成一个完整 的大学制度伦理体系。大学制度实质伦理是对大学制度规则等实质内容的价值取向 认识及伦理评价。大学制度规则的价值诉求多元而复杂，集中表现在理性主义和功 利主义两大思想的冲突和博弈上
3、，但促进人的全面发展、学术自由和社会发展这三 方面是大学制度规则的合理性基础。大学制度形式伦理是对大学制度规则的制定、 执行及评价程序的价值取向认识及伦理评价，制定伦理、执行伦理及评价伦理是其 三个表现形态。值得重视的是，大学制度形式伦理具有独立性，其合理性内涵表现 在中立和平等对待、民主参与、公开、科学、效率、稳定等方面。大学制度主体伦 理则是指对大学制度主体在进行制度活动时行为的价值取向认识及伦理评价。主体 的行为自由必须基于一定的责任基础之上，因而，大学制度主体的行为必须承担相 应的实质伦理责任和形式伦理责任，即必须承担公正责任、学术自由和发展责任、 促进人的全面发展和社会发展责任，在制
4、度活动中还必须履行中立和平等对待、民 主参与、公开、科学、效率、稳定等伦理责任。 当前中国高等教育正处于转型的特殊时期，大学制度也面临着改革的挑战，由 一个与计划体制相适应的大学制度体系转变为与社会主义现代市场体制相适应的大 学制度体系，由一个适应精英教育模式的大学制度体系转变为适应大众教育模式的 大学制度体系。这一时期，由于大学组织内外环境的变化，中国现行大学制度出现 II 华华 中中 科科 技技 大大 学学 博博 士士 学学 位位 论论 文文 了一系列伦理危机。实质伦理方面，功利主义的极端和异化趋势导致大学制度出现 了组织结构设计过度科层化、制度权力体系不均衡及学术制度规则的急功近利等合
5、理性危机；形式伦理方面，由于忽视形式伦理，大学制度形式合理性缺失的现象严 重，主要表现在制度程序过弱的民主参与性、过强的封闭性、中立性缺失、过低的 有效性等方面；主体伦理方面，受极端个人主义和自由意识高涨等因素的影响，大 学制度主体忽视了自身的责任和义务而专注于权益和利益的追逐，以致其行为超过 了自由的限度而未履行一定的伦理责任，导致诸多合理性弊病出现，不仅不作为、 渎职现象趋严重，而且腐败犯罪行为激增。 针对中国现行大学制度伦理的诸多现实问题，在批判的基础上必须进行深入的 反思，并建构出切实可行的完善方案，以促使大学制度的合理性在实践中得以真正 建立和全面实现。就大学制度规则来说，超越功利主
6、义、促进功利主义与理性主义 大学观的融合与平衡是克服中国现行大学制度实质合理性危机的根本措施。对于中 国现行大学制度形式伦理的弊病，可以建立一套比较符合中国国情和校情以及时代 发展的大学制度听证体制，对大学制度程序的公正合理性进行有效监督和保障。而 针对中国现行大学制度主体未能履行伦理责任的现状，重塑主体的责任意识，并对 主体实际责任履行现状予以有效监督和及时评价，以保障责任履行的连续性和持久 性，这是促进大学制度主体行为合理性的现实路径。 关键词关键词：大学制度 制度伦理 大学制度伦理 合理性 III 华华 中中 科科 技技 大大 学学 博博 士士 学学 位位 论论 文文 Abstract
7、In recent years, university institution study has become the focus in higher educational academic circle. At present, although most of the existing achievements about university institution treat university development as institutional evolution according to New Institutional Economics analysis para
8、digm, in some ways, these works are not hit the point essentially. In fact, university institutional ethical issues, namely the rationality of the university institution, are the essential issues during the foundation, innovation and development of university institution. Most of its negative influe
9、nce is derived from the deficiency of the university institutional rationality. In order to fill the blank of this issue, my dissertation will study university institution from the perspectives of institutional ethics, especially pay more attention to the ethical crisis of university institution dur
10、ing the transformation of higher education modernization in China with critical reflection, which has important theoretical value and practical significance. University institutional ethics is the appeal for rationality of university institution, namely, evaluating the value of university institutio
11、n in the light of certain principles. In multivariate and complicated evaluation criterions, justice is the first standard and academic development is the fundamental criterion. University institutional ethics chiefly includes three parts of contents: the substantive ethical problem, the formal ethi
12、cal problem and the subject ethical problem. In the above three, they are interdependence and mutual influence, constitute a complete system of university institutional ethics. The substantive ethics of university institution refers to the understanding and ethical evaluation on the value orientatio
13、n of university institutional rules. The value demands of university institutional rules are pluralistic and complicated. Rationalism and utilitarianism orientation are the concentrated expression of the values conflict and game. But all-round development of human being, academic freedom and promoti
14、ng social progress are the rationality foundation of university institutional rules. The formal ethics of university institution is the understanding and ethical evaluation of the value in university institutional procedure.
