1、沈阳师范大学 硕士学位论文 我国高校后勤社会化中大学生权利研究 姓名：景时 申请学位级别：硕士 专业：教育经济管理 指导教师：张维平 20100401 1 我国高校后勤社会化中大学生权利研究 内 容 摘 要 当今社会日益重视法制建设，人的权利越来越受到关注。然而，在高校社会 化改革的过程中，大学生的权利却没有受到足够的重视，大学生后勤生活质量差、 没有自由选择的余地、权利受到侵害却无力救济等问题日益凸显。因此，本文选 此论题进行研究，以促进社会对大学生权利的关注。本研究主要采用文献研究法、 调查研究法、案例研究法和比较分析研究法，认为高校后勤大学生权利是大学生 法律关系主体为了获得适宜的后勤生
2、活与学习环境根据自己的意志而做出的作 为或不作为，或者要求国家、学校、后勤企业作为或不作为的能力与资格。主要 包括安全权、自主选择权与监督参与权。本文由以下四个部分组成： 第一部分，引言。主要阐述了选题的背景、研究目的和研究内容，对已收集 的文献进行了综述，接着阐述了本研究的理论意义及实践意义，最后阐明了本研 究的研究思路与研究方法。 第二部分，关于高校后勤社会化大学生权利的基础理论研究。首先分别论证 了我国高校与学生之间以及后勤与学生之间的法律关系性质。然后，界定了高校 后勤社会化中大学生权利的内涵与外延。最后，运用教育学理论、法理学理论和 经济学理论对高校后勤社会化大学生权利进行了论证。
3、第三部分，高校后勤社会化中大学生权利的现实状况分析。主要对相关的法 律法规进行梳理， 在此基础上对我国高校后勤社会化中大学生权利相关的法律规 定进行分析，发现其中存在的问题，并结合高校后勤社会化中侵犯学生权利的典 型案例来阐释高校后勤社会化中对大学生权利侵犯的表现形式， 最后对阻碍我国 高校后勤社会化中大学生权利实现的因素进行阐述。 第四部分，构建我国高校后勤社会化中大学生权利保障体系。首先，介绍了 发达国家及地区的高等学校后勤管理的经验。 然后针对我国高校后勤中大学生权 利缺失存在的问题， 构建高校后勤社会化中大学生权利的保障体系并提出相应的 对策。 关键词：教育法学，权利，大学生权利，高校

5、g construction of legal system, during the reform of higher education, the rights of the college students have not drawn enough attention. For instance, the students can only accept what is provided, having a poor quality of life, and when their rights are violated, they are incapable to obtain reme
6、dies. Nowadays, the problems become serious. Thus, aimed to draw the attention of the whole society to the rights of the students, this dissertation addresses the issue, a task which the author employs various methods, such as analyzing documents, conducting research, proposing examples, and making
7、comparison to fulfill. As suggested, the rights of college students refer to not only the action or non-action performed by the students, the subject of legal relation, who, based on their own will, decide how to gain the favorable logistical service in life and environment of study, but also the po
8、wers and qualifications granted to the students to require the country, the college and the logistics company to act or non-act, including the right to get safety, the right to make a choice, and the right to perform supervision. The dissertation is classified into four sections: In the first sectio
9、n, introduction, a brief overview of the dissertation study is stated, concerning about the reasons of choosing this subject, the purpose and the content of the research. At first, the materials involved are generalized, then, the significance of the study, theoretically and practically, is discusse
10、d, and at last, the guideline and methods are introduced. In the second section, regarding to the rights of college students, the fundamental and theoretical research is conducted, i.e. nature of the legal relation between the college and the students, as well as, between the logistics company and t
11、he students are expounded respectively. Given the premise, the connotation and extension of the concept, the rights of college students in the process of socializing logistics in the higher education system of China, are stated. After that, by introducing relevant theories in education, jurisprudenc
12、e and economics, the author justifies the rights of 3 the college students. In the third section, the condition of the rights of the students in the process of socializing logistics in higher education is analyzed. At first, the laws and regulations related to the rights of students are outlined, an
13、d based on the results, the writer figures out the problems, and by providing typical examples he describes the forms of violation. Finally, the factors which prevent the students from enforcing their rights are listed. In the forth section, the ways to construct the guarantee system for the rights
14、of college students in the process of socializing logistics in higher education system of China are recommended. In this part, firstly, the experiences of some developed countries and regions in managing logistics are described. Secondly, the problem is discussed-the students have not sufficient rig
15、hts in obtaining good logistical service in higher education system of China, laying down the foundation to advocate the establishment of the guarantee system.
