1、中国海洋大学 硕士学位论文 海域公共资源市场化管理问题与对策研究 姓名：孙雪甜 申请学位级别：硕士 专业：工商管理 指导教师：杨林 2011-05 5 海域公共资源市场化管理问题与对策研究 摘 要 改革开放尤其是 2002 年颁布 中华人民共和国海域使用管理法（以下简称 海 域使用管理法 ）以来，我国的海洋事业得到了长足的发展。但是， 海域使用管理 法只是为海域管理提供了法律制度平台，并未改变行政审批作为海域资源配置主 要方式的现状，这与我国社会主义市场化经济体制的要求相悖。只有确立市场化管 理的主导地位，才能完成我国海域资源管理模式的根本转变，发挥市场对海域资源 配制的作用，提高海域资源的管
2、理效率。因此形成系统科学的海域市场化管理理论 和方法体系，对于指导海域市场化管理实践，并促使我国海洋综合管理跃升一个新 的高度具有重要的理论和实践意义。 论文的研究目的在于通过对海域公共资源市场化管理理论依据的探讨和对国外 通行做法的借鉴，找出我国现阶段海域资源管理存在的问题，最终提出加强海域资 源市场化管理的基本思路与具体对策， 为今后我国海域资源的市场化管理提供参考。 论文以新制度经济学的产权理论、新公共管理理论、海洋综合管理理论、海域 物权理论等为理论基础，采取规范分析和实证分析相结合、定性分析和定量分析相 结合、理论分析和对策分析相结合、纵向历史分析和横向国内外现实比较分析相结 合的方
3、法揭示研究我国海洋资源资产开发利用问题的经济学根源、产权问题等等。 论文首先分析了海域公共资源市场化管理的理论基础及其现实必要性，在对我 国海域资源传统管理的内容、方法及各个层面存在的问题进行分析的基础上，深入 地阐述了我国海域资源市场化管理的可行性、运行机制及监管机制。其中对于海域 资源市场化管理的运行机制的论述，是从海域资源价值评估机制和海域资源市场交 易机制两方面进行了较为深入系统的重点分析。并且还定量地分析了我国海域市场 化流转交易的现状。在以上分析基础上，总结出了海域资源市场化管理存在的问题 与障碍。 论文进而考察了国外海域公共资源市场化管理的发展过程及相应制度等实践情 况，并通过比
4、较分析总结了需借鉴的成功经验。在以上所有分析的基础上，论文最 后提出了加强我国海域资源市场化管理的基本思路与具体对策。 论文取得了以下成果：对我国海域资源传统管理进行了系统梳理，明确了传统 6 的一般性管理对于海域资源管理是必要的；从海域资源价值评估机制和海域资源市 场交易机制两方面对于海域资源市场化管理的运行机制进行了较为深入系统的研 究， 从而明确了海域资源市场化管理的运行机理； 以近五年的海域统计数据为依据， 对我国海域资源市场化流转交易的现状做了定量分析，更为直观地了解我国海域资 源市场交易机制的实际运行状况；较为系统地提出了加强我国海域市场化管理的一 系列对策建议。 关键词：海域；公
5、共资源；市场化管理；流转 7 Research on Problems and Measures of Market Management of Public Resources of the Sea Area Abstract Since Reform and opening-up, especially (hereinafter referred to as ) promulgated in 2002, our countrys Marine programs have developed rapidly. But only provides some legal system platf
6、orm for the management of sea area, did not change the present situation that the administrative examination and approval is the main way of sea resources allocation, which run counter to requirements of socialist market economy system. Only by establishing market management as leading status, can i
7、t complete fundamental transformation of resource management mode of our sea area, and bring the market in maritime resources configuration of action to improve the efficiency of management of the resources of sea area. Thus the forming of systematic and scientific market management theory and metho
8、d system of sea area has important significance in theory and practice for guiding the market management practices of sea are and promoting comprehensive Marine management of our country jumped to a new height. This study aims to find out the our country present stage sea resources management proble
9、ms through the discussion about theory basis for market management of public resources of sea area and reference of foreign practices. Finally this paper put forward the basic ideas and concrete countermeasure for strengthening market management of the sea resources, in order to provide the referenc
10、e for market management of the sea resources in the future. Firstly, the paper analyzes the theoretical basis and practical necessity which the market management of marine public resources has. The paper goes into some details of 8 the market feasibility, operation mechanism and supervision mechanis
11、m of our marine resources management on the base of analyzing the content, methods and problems in all levels of the traditional marine resources management. Among them the discussion about operation mechanism of market management of the sea resources has in-depth systematicly and stressly is made i
12、n two ways, that one is evaluation mechanism of value of sea resources, other one is market trading mechanism of sea resources. The paper analyzing quantitativly the situation of market turnover of our marine then sums up the problems and obstacles the market management of marine resources have. The
13、 paper examines a series of rules and regulations in the market-oriented management of public resources of foreign seas, and sums up successful experience by comparing and analyzing. Based on the above analysis, the paper concludes with the basic ideas and the specific measures strengthening market
14、management of marine resources. The paper obtains the following results. Through clearing the traditional management of marine resources systematically, it clear that the traditional management is necessary for the marine resources management. In evaluation mechanism of value of sea resources and ma
15、rket trading mechanism of sea resources two ways, in-depth systematicly and stressly discuss about operation mechanism of market management of the sea resources. Based on data of the sea area in the past five years, the paper makes quantitative analysis on the status of market-oriented management of
16、 marine resources. And it systematically proposes a series of suggestions of strengthening the market management of our seas.
