1、河南大学 硕士学位论文 改革开放三十年来我国政府合法性的维护与构建 姓名：张昭 申请学位级别：硕士 专业：政治学理论 指导教师：张胜利 2011-04 I 摘 要 1978 年 12 月召开的十一届三中全会标志着中国改革开放伟大事业序幕的拉开和社 会主义新中国新征程的开始， 经过 30 年的发展中国的面貌和中国人民的面貌焕然一新， 赢得了国际社会的赞誉和国内社会大众的一致认可，实践证明，改革开放顺应了历史和 时代发展的潮流、方向和道路，符合全国人民的心中的愿望，三十年来所取得的功绩是 不容怀疑和否定的。 与我国高速发展相伴随的是国内社会也发生了激烈而动荡的天翻地 覆的变化，中国政府也不得不面对
2、国内环境的新变化而引起的各方面的挑战和风险，合 法性的挑战就是其中的一种。中国是最大的发展中国家，从已有的发展中国家的经验来 看，发展中国家从传统社会向现代社会转型的过程中最易产生合法性危机；其次从政治 发展的角度来讲，政治体系在社会变迁的过程中都不同程度地面临着合法性危机的问 题，正如哈贝马斯所指出的那样合法性危机并不是现代社会所特有的，我们可以在一切 较早的文明，甚至在古代社会中发现合法性冲突本身的存在。在整个政治系统中，政府 是重要的组成部分，并且政府已作为国家的具体化身，在现实政治中取代国家履行具体 的社会管理职能和统治职能，体现出更多的社会性和公共性。在这里，本文主要分析作 为政治系
3、统重要组成部分的政府在改革开放以来，尤其在 19782008 年这三十年当中 所面临的合法性问题， 本文从政府系统内部的和政府对社会和公民施政战略的调整两个 方面来分析政府对自身合法性的维护和构建。 本文除引言之外，共分四个部分。第一部分是政府合法性问题研究的理论前提。主 要是对合法性、合法性基础、合法性危机、政府合法性等概念和理论进行系统的梳理以 作为本论文的研究理论基础和前提。 对历史上有关学者对合法性相关问题的研究做系统 的回顾和反思，借鉴由马克思韦伯开创的经验主义合法性理论研究的范式和哈贝马斯 对合法性理论的思维范式来探讨政府合法性的问题。 II 第二部分主要指出政府在改革开放以来所面
4、临的合法性危机。 改革开放已使得政府 依赖的传统合法性基础发生了嬗变，国际、国内环境的新变化已给政府的合法性构成了 危机，这些危机主要有：一是传统合法性基础的消解带来的合法性危机；二是公民主体 意识的觉醒和公民社会的崛起构成的合法性危机；三是政府成员腐败构成的合法性危 机；四是政府有效性能力的下降构成的合法性危机。 第三部分主要撰写政府围绕着对自身构成合法性危机的问题而进行的合法性维护 和构建。维护的构建合法性的手段和措施比较多样化，本文主要从政府系统对自身内部 的调整和政府对社会、公民所做的施政战略的调整两个方面入手进行分析，政府内部自 身的调整采取的措施主要有：一是政府通过对自身机构的精简
5、，通过提高工作效率，提 高工作透明度来提高合法性； 二是通过规范政府与执政党之间的关系来构建属于自身系 统的合法性；三是通过构建法治政府，依法行政来开拓新型的合法性；四是从政府内部 清理、清除影响合法性的体制和人为因素，进行反腐败建设和廉洁政府建设来控制合法 性基础的流逝，从而相应的保持、增加合法性；五是通过转变政府职能，以建立适应社 会主义市场经济体制和社会发展形势的职能为目标， 将职能锁定在“经济调节、市场 监管、社会管理和公共服务”四个大方向上。第二个方面政府通过对社会和公民工作重 心的调整来谋取合法性，主要措施有：一是利用经济增长所带给人们的切身好处来增加 自身的合法性；二是通过与社会
6、和公民的互动沟通，进行民主选举和政治参与，开拓合 法性构建的新途径，这主要从人民代表大会、农村村民委员会和城市居民委员会三个方 面进行分析；三是通过维护社会的公平、正义等价值来维护自身的合法性。 第四部分是全文的结论。基于以上分析，针对政府改革开放以来所采取的措施，论 文最后提出一些建议。 本文的创新之处在于：第一，本文从政府赢取自身的合法性这个角度出发，将政府 对其内部的改革和政府对社会、 公民工作实证战略的调整两个方面入手来剖析政府为维 护自身的合法性做出的努力，拓宽了以往分析政府合法性的视角。 第二，本文从政府内部机构的调整入手，把政府自身组织构架的调整、政府职能的 转型、政府与其他权力
