3、e of Computer Science College of Computer Science Submitted Date: May 2009May 2009 浙江大学硕士学位论文 摘 要 i 摘 要 摘 要 随着我国各项法律制度的不断完善和健全,对庭审公开、公正、高效、透明 的要求及呼声日益增多。为了进一步满足社会发展的需要,2008 年最高人民法院 发文指出,及时改革传统庭审模式,建设数字法庭是法院信息化审判工作发展的 方向。 数字法庭系统能够完整、准确地记录和再现庭审过程,在提高法院的社会公 信度及法官自身素质和审判水平的同时,充分体现了人民法院一贯追求公正与效 率的工作主题。远程

4、审判系统在降低提押风险、节约法院警力、降低交通成本的 同时,也为异地质证、脆弱证人保护等审判业务应用提供支持;另一方面也可以 进一步扩大庭审公开的范围,提高庭审的透明性和公正性,具有广阔的应用前景 和深远的社会效益。 本文以杭州市中级人民法院数字法庭远程审判系统为研究背景,重点论述了 数字法庭及远程审判系统的总体架构、关键技术、实现方法等。论文的主要工作 如下: (1)提出了数字法庭及远程审判系统架构,介绍了数字法庭系统的整体布 局及设备控制架构,论述了远程审判系统的总体架构设计,包括远程开庭布局、 本地和远端法庭的功能需求。 (2)详细阐述了关键技术,主要包括 SOA 概念和基本框架,以及

5、Windows 通信基础(WCF)技术及其服务和模型,重点论述了这两种技术在本系统中的应 用。 (3)展示了数字法庭远程审判系统的实际应用效果,给出了系统运行实例。 最后,对未来数字法庭远程审判系统进行跨系统应用和互联网应用进行了展 望。 关键词:关键词:数字法庭, 远程审判, 面向服务架构(SOA), Windows 通信基础 (WCF), 分布协同,传输控制 浙江大学硕士学位论文 Abstract ii Abstract The continuous improvements of the legal system in China have been asking for judgmen

6、ts of justice, efficiency, openness and transparency. To fulfill these purposes, establishment of digital court is prioritized as one of the major directions of reform of traditional court system, according to the guideline announced by the Supreme Peoples Court of China in 2008. Digital court is a

7、high-tech system which can resolve the problem of records and reappearances for the process of trials with features of completeness and accuracy. It thereby can help ensure the credibility of Chinas legal systems, and also promote the professionalism of judges. The system fully reflects the idea of

8、Peoples Courts that pursuit of justice and efficiency is the goal of work. The long-distance trial systems can reduce risk of detains, save the court police forces, reduce the transportation cost as well as supporting for questioning witnesses in another area and protecting the vulnerable witness. 9、n the other hand, it can also further expand the scope of public hearing to improve the transparency and the fairness of the trial. It has the broad application prospects and the far-reaching social benefits. The thesis took the digital court distance trial system of the Intermediate Peoples Court i

10、n Hangzhou as the study background. This thesis focuses on the frameworks, key techniques and realization methods of the digital court distance trial system. The main work of this thesis is as follows: (1) The architectures of digital court and distance trial system are presented, the overall arrang

11、ement of the digital court system and equipment control structure are introduced, and the general framework for the distance trial system design is discussed, including distance trial systems layout, and the functional requirements of the local and remote courtroom. (2) The key techniques are studie

12、d in detail, including the concept of Service Oriented Architecture (SOA) and its basic framework, and Windows Communication Foundation (WCF) technique and its service and model. 13、l demonstrations of digital court distance trial system are shown in the end, including the examples of system operation. Finally, across applications and Internet applications of the digital court distance trial system in the future are discussed.
