本文分析了“东台发绣”发展的源流、技术的革新、保护的现状，从知识 产权保护的角度提出对发绣的保护的方法从“东台发绣”图案的著作权和邻接权保 护、“东台发绣”工艺品的专利权保护、到“东台发绣”的商标及域名保护以及运用反 不正当竞争法对发绣产业的市场规制，透析了保护“东台发绣”的经济、社会效益，揭 示了其知识产权保护面临的突出问题最后，针对知识产权在保护非物质文化遗产方面 所具有的局限性，提出一些个人的建议，阐述我国法律体制的完善、知识产权法的突破 以及引入惠益共享机制 关键词：发绣 知识产权 非物质文化遗产 华 中 科 技 大 学 硕 士 学 位 论 文 华 中 科 技 大 学 硕 士 学 位 论 文 II Abstract Abstract Intangible cultural heritage is a nation living memory and shengmin gene displayed the wisdom and the spirit of the nations expression of the same heritage and the intangible cultural heritage of human civilization. Chinas intangible cultural heritage, the types of large colorful scene contains the Chinese nations cultural values, historical background, ways of thinking, the Chinese cultural tradition for thousands of years of treasures. Strengthen the protection of intangible cultural heritage is the historic mission of the country and the nation, is today the international community to an inevitable choice for the transmission of civilization. Dongtai embroidery made in Jiangsu province, one of the intangible cultural heritage, has great historical value, cultural content, cost-effective. Their protection is also a new issue, the protection in a variety of ways, this article is based on "Taiwan-made embroidery East" as an example of intangible cultural heritage protection of intellectual property rights to carry out case studies in order to "Taiwan-made embroidery East" as a breakthrough point, trying to put forward under the framework of intellectual property rights of non-material cultural heritage protection method. In this paper, theory and field research, based on an analysis of Taiwan-made embroidered Eastern origins of the development of technological innovation, the protection of the status quo, from the perspective of protection of intellectual property rights protection on the hair embroidery. Made from embroidered logo dongtai copyright and neighboring rights protection, dongtai embroidered handicrafts made of patent protection, to the east of Taiwan issued the trademark and domain name embroidered protection, as well as the use of Anti-Unfair Competition Law of the Market Regulation made embroidery industry, dialysis made the protection of the East Taiwan embroidered economic, social, and reveal its intellectual property protection problems faced by, that is made of embroidery industry confusion, the Government played a limited role in guiding norms and the very existence of loopholes in the benefit-sharing mechanisms; Finally, dongtai embroidered on the protection of intellectual property rights made some suggestions. 在全球化趋势的洪流中，随着工业文明的进程加快，非物 质文化遗产保护面临前所未有的严峻形势大量优秀的非物质文化遗产有的被遗忘，有 的被无节制的开发利用，失去了原有的韵味，更有甚者，由于缺乏有效地传承和保护而 逐渐没落了如此，对非物质文化遗产保护已经是迫在眉睫 保护非物质文化遗产实际上就是保护民族的传统的思想灵魂， 保护中华民族的历史 文化精髓目前在国际上已有不少国家进行了有益的探索亚洲的日本、韩国、印度等 国家的保护工作已走在我们的前面，欧洲的法国、意大利的非物质文化遗产保护工作也 早已开展在这样的形势下，中国的非物质文化遗产保护工程也开始启动了各项保护 措施逐渐进入实施阶段而对于有争议的问题，学界也展开了激烈的讨论其中以知识 产权法为核心建构法律保护体系，是谈论最多的话题，许多专家学者提出了有益的设想 和制度上的应对措施 江苏是中国古代文明文化的发祥地之一，文化遗产资源十分丰富，不仅有大量的物 质文化遗产，也有丰富的非物质文化遗产有苏州刺绣、宜兴紫砂陶艺、南京云锦等， 有各种礼仪、节庆活动，如秦淮灯会，民间传说如“梁祝” （宜兴） “董永传说” （东台） ， 传统手工技艺如苏州缂丝织造技艺、南通蓝印花布印染、东台发绣等，都是江苏非物质 文化遗产的组成部分。
东台市是苏北的县级市，也有许多有特色的非物质文化遗产，如 列入国家级非物质文化遗产的“董永的传说”江苏省级非物质文化遗产如东台发绣等 2003 年联合国教科文组织第 32 届会议通过了《保护非物质文化遗产公约》 ，中国于 2004 年 8 月加入该公约此后，我国的《非物质文化遗产保护法》也在紧锣密鼓的制定 之中保护非物质文化遗产是维护中华文明，保护民族精神传承，促进文化多样性的重 要手段，可以为人类的文明做出自己的贡献非物质文化遗产，它也是我们民族的知识 体系当中的一部分非常重要的宝贵财富 它凝结着我们的历史记忆， 它既是昨天历史的、 华 中 科 技 大 学 硕 士 学 位 论 文 华 中 科 技 大 学 硕 士 学 位 论 文 2 生活的见证，同时也是我们今天生活现实的有效地记载，对于未来的文化发展来说，也 是一个非常重要的基础它和以智力成果为保护对象的知识产权法的关系，我国知识产 权法对非物质文化遗产的保护状况、方法，知识产权法以外的其他法律在保护非物质文 化遗产方面可以发挥怎样的作用，都是本文着力探讨的问题 关于非物质文化遗产，目前理论界的论述较多，具体实例研究甚少，分析问题时也 是在理论的角度提出一些设想，难以具体的付之实践。
