4、”产生的原因，指出“问题专利”源自专利制度的系统失灵，造成“问题专利”的原因是多方面的，如专利权保护的垄断性预期引发专利申请竞赛，专利审查资源的有限，大量不当或错误授权的“问题专利”由此产生。再阐明“问题专利”对消费者福利公平竞争和技术创新的影响及其机理。专利制度在本质上保护的是创新者占有市场的排他权，而这种排他权的实现依赖于第三人或者权力机关对有效性的认可。由于第三人对“问题专利”的权利有效性认可度较低，权利持有人试图通过机会主义诉讼和反竞争诉讼实现排他权，这是一种有害的权利寻租行为。最后介绍归纳我国在应对“问题专利”的法律制度安排并提出了完善建议。关键词：问题专利专利权不确定性专利权滥用I

The righteousness of thepatent system is based on stimulating innovation and making up for the loss oninefficiency brought by monopoly with faster innovation.Since China introduced thepatent system, our soci
6、al innovation capacity significantly improved. However, there havebeen some problems, plus the number of people blind pursuit of patent deficiencies of thepatent examination system lead to a lot of “questionable patents”. The impact of “Thequestionable patents” on the interests of individuals and pu
7、blic interest arousedwidespread concern.This thesis defines and categorizes the concept of “questionable patents” at thebeginning. Then this essay concluded the causes how “questionable patents” are produed.The “questionable patents”are partly derived from the dysfunction of the patent system.Variou
8、s factors must be taken into accout such as the competition of patent application thepursuit for the monopoly of the patent protection and the limited patent verificationresources.As a result, a large number of inappropriately or illy authorized “questionablepatents”have emerged. After this, this th
9、esis elaborates the impact of “questionablepatents” on the consumers welfare, fair competition, and technological innovation. Thepatent system in essence is to protect the exclusive rights when innovators occupy themarket. This exclusive rights must be certified and accepted by a third party or anau

However, the third party usually does not think highly of the validity of“questionable patents”, and the “questionable patents” owner tries to make rightsexclusive through opportunistic litigation and anti-compellation litigation. This is aharmful behavior of rent-seeking. Last but not leas
