3、杨宗辉教授在 侦 查学前沿问题研究一文的论述。杨教授从信息论的角度指出案件沦为疑难案件主要原因 在于案件及有关问题的信息暴露不充分或者是侦查人员信息解读失误，见解可谓独特。 本文集中阐述了疑难案件的相关概念， 构成要素及特征， 围绕疑难案件可能形成的原因， 做出了相应的分析。剖析了疑难案件的内涵，论述了疑难案件形成的机理。就疑难案件的 特征、成要素及成因提出了个人的看法。同时丰富了疑难案件的应对策略。本文中，存在 很多自己的见解，可能对当前的论述是一种挑战，同时也是对当前认识的补充。 本文应用了规范的研究方法进行专题研究。全文共分三部分：第一部分，主要讨论了疑 难案件的概念、构成要素和特征；第
4、二部分，则从实践的角度，对疑难案件的形成予以分 析，进而形成理性的思维认识；最后，则从宏观和微观的层面对疑难案件的解决方法提出 了相应的应对策略和方法 本文主要创新处体现在：第一，对疑难案件的概念提出了自己的看法，认为判定案件是 否沦为疑难案件的认识主体应当是具有全社会侦查平均认识水平的人员。第二，提出了疑 难案件的构成要件和特征。特别是疑难案件的构成要件的提出，相对来说，还是很具有创 新意义。毕竟案件的定性和定量上，应当有所规定。第三，从侦查人员在侦查过程中的侦 查模式角度出发，研究案件沦为疑难案件的原因，更具有可操作性和认识性，对这样的认 识上升为理性认识后，可以更好地为侦查人员提供理论参
