3、之地。历经数百年的发展与完善，许多国家地区的立法、判例和学说都对该制度 作出了规定，在司法领域与实践领域得到了大家的普遍认可。我国也不例外，我国 1999 年颁布的合同法对缔约过失责任作出了规定， 体现出对缔约当事人合法权益的扩大化保 护，也体现了合同法的价值关怀。然而，我国的法制建设在不断的发展和完善之中，立 法上不完善的规定并不能解决缔约过失责任在迅猛发展的当今社会中出现的问题。 再加 上相对于其他民事法律制度，缔约过失责任制度理论基础尚浅，内容庞杂，法律规定又 比较笼统，导致了在司法实践中可操作性不强、实践中问题重重。本文以缔约过失责任 制度为研究对象，以最大限度的保护缔约当事人利益为主
4、旨，先从我国缔约过失责任的 现状入手，对缔约过失责任与相关民事制度进行了司法界定；然后通过借鉴有关国外的 法律规定及判例，在结合了本国的司法案例基础之上，发现我国缔约过失责任制度的不 足，进行反思；最后对完善缔约过失责任制度提出建议与设想，以增进我们对缔约过失 制度的了解，妥善解决司法实践中所遇到的难题，为最终建立一个以诚实信用原则为基 础的缔约过失责任制度，贡献自己的绵薄之力。 关键词 缔约过失责任 诚实信用 信赖利益 先合同义务 损害赔偿 Abstract II Abstract The contracting negligence liability system is born in
5、the modern civil law in the field of the contract law to an important legal system. It is a good way to solve the contract to protect of the treaty level and to avoid the contract concluded the process, which is as the legal adjustment blank land. After hundreds of years of development and perfectio
6、n, many countries regions of the legislation, cases and the system theory all made a provision in the field and the practice field got everyones general approval. Our country is also not exceptional, China promulgated in 1999 of the contract law contracting negligence liability made a provision, whi
7、ch reflects the legitimate rights and interests of the contracting parties to protect the utterance. It is also reflected the law of contract value concerns. However, our legal system in the unceasing development and perfection of the legislation is not perfect and it cant solve the provisions of th
8、e treaty negligence liability in the rapid development of the problems in todays society. Plus, relative to other civil law systems, the contracting negligence liability system theory foundation is shallow, possibly content, law and are general, leading to the operation in the judicial practice is n
9、ot strong, the problems in practice. In this paper the contracting negligence liability system as the research object, by the maximum protection contracting parties interests as the theme.
