1、安徽大学 硕士学位论文 我国公立高等教育财政投入法律制度研究 姓名：陶呈成 申请学位级别：硕士 专业：经济法学 指导教师：华国庆 2010-04 I 摘 要 摘 要 教育事业的发展，首先需要的就是经费。合理、高效的高等教育财政投入 制度是我国公立高等教育事业健康发展的基础。自 20 世纪 90 年代至今，我国 的高等教育经历了跨越式的发展，与此相适应，中央在高等教育财政制度方面 也进行了诸多改革与探索。尤其是改革开放以来，我国各级政府逐步加大了包 括公立高等教育在内的高等教育的财政投入，这对于推进我国公立高等教育事 业的发展起到了十分重要的作用。但需指出的是，与世界上高等教育比较发达 的国家相
2、比，我国对包括公立高等教育在内的高等教育财政投入仍然存在诸多 问题，如财政投入总量不足，财政投入不均衡，中央与地方政府的财政转移支 付不到位，教育财政投入立法滞后等问题。鉴此，从财政法的视野对公立高等 教育投入法律制度进行研究，对于构建完善的公立高等教育财政投入法律制度， 促进公立高等教育事业的健康发展无疑具有十分重要的意义。公立高等教育作 为公共产品，对公立高等教育的财政投入是政府应当承担的责任。 本文从三个方面对我国公立高等教育财政投入法律制度展开论述。第一部 分介绍国外公立高等教育财政投入法律制度及其对我国的启示，通过对美国、 英国、日本三国公立高等教育财政投入制度的比较分析，总结出国外
3、高等教育 财政投入法律制度对我国的几点启示。第二部分分析了我国公立高等教育财政 投入法律制度的现状及其存在的问题，尽管我国高等教育财政投入制度建设取 得了一系列的成就，但是还是面临着严重的问题，这些问题主要表现在：公立 高等教育财政投入总量不足；公立高等教育财政拨款方式不合理；高等教育财 政投入地区发展不平衡；高等教育财政财权与事权相分离；公立高等教育财政 投入法律监督制度不完善。第三部分提出了完善我国公立高等教育财政投入法 律制度的建议，主要包括：加大对公立高等教育财政投入的力度，完善多渠道 筹措公立高等教育经费的财政体制；改革公立高等教育的财政拨款方式；完善 公立高等教育财政转移支付制度；
4、健全公立高等教育财政投入的预算管理体制； 建立有效的公立高等教育财政投入法律监督机制。 关键词： 关键词：公立高等教育；财政投入；财政拨款；财政转移支付 II Abstract The primary need of education is funds. A reasonable and efficient financial investment system on higher education is the foundation of the healthy development of public higher education in our country. Since 19
5、90s, our higher education has developed by leaps and bounds. Meanwhile, the central government has made lots of reformation and exploration on financial system in higher education. Especially from the reform and opening up, the governments from the local to the central have gradually intensified eff
6、orts on financial investment in public higher education, which plays an important role in the development of public higher education, but we should point out that comparing with countries which are more developed in higher education, there are still some problems in financial investment in our highe
7、r education, including public higher education, such as the lack of total financial investment, imbalanced financial investment, with the central and local governments fiscal transferring payment not being in place, education and financial investment legislation lagging behind. In view of this, it i
8、s undoubtedly of great significance for us to study financial investment in Chinese public higher education from the perspective of researching public finance law, for building a healthy financial investment in public higher education legal system, promoting the healthy development of public higher
9、education. Higher education is a public goods, so it is the governments responsibility to manage financial investment in public higher education. In this paper, the author discusses the legal system on financial investment in Chinese public higher education from three aspects. In the first part, the
10、 author introduces the legal system of financial investment in overseas higher education as well as the enlightenment for us. By analyzing the system of the USA, the UK and Japan, the author summarizes several points of enlightenment; in the second part, the author analyzes the situation of the lega
11、l system on financial investment and existing problems. Although the system has made a lot of achievements, there are still some III problems, such as the lack of total investment, unreasonable allocation, imbalanced development of the system in different areas, the separation between routine power,
12、 financial power in higher education financial system, incompletes law supervising system. In the third part, the author proposes several advices of perfecting the legal system of our financial investment in higher education, including intensifying the input for higher education, improving the finan
13、cial system of collecting fund in multi-channels, reforming the allocating mode of financial investment, perfecting the transferring payment system, building a sound budget management system, and establishing an efficient legal supervising system of financial investment in public higher education. 14、ey words: public higher education; financial investment; financial allocations; fiscal transferring payment 引 言 1 引 言 引 言 随着经济全球化的深入发展，国家间的联系愈发紧密，竞争也日趋激烈。 21 世纪国家间的竞争主要表现为科学技术的竞争，于是知识越来越成为提高国 家综合国力和国际竞争力的决定性因素。高等教育作为知识的贮藏器、发电机 和传送器，在为国家提供科学、技术、专业及管理等各方面的高级人才上发挥 着至关重要的作用。大力发展高等教育，是推进“科教兴国”战略的实施、适 应 2
15、1 世纪社会经济发展的需要，也是历史的必然选择。 无论是义务教育还是高等教育的发展，首先需要的就是经费。政府对高等 教育财政投入是高校日常教学和管理工作运转所必需的经费的主要来源。合理 有效的高等教育财政投入制度是整个高等教育事业高效运行和健康发展的基本 保证。自党的十六大以来，在党中央、国务院领导的高度重视下，通过各级政 府和教育、财政等部门的共同努力，我国高等教育经费筹措机制进一步完善， 财政投入不断增长，为高等教育迅速发展提供了有力保障。尽管如此，高等教 育的财政投入仍然跟不上现今高等教育迅速发展的步伐。随着改革开放的进一 步发展，高等教育财政投入制度的研究引起了我国教育界、法学界及经济
