1、华中科技大学 硕士学位论文 作品的概念、本质及独创性研究 姓名：张扬 申请学位级别：硕士 专业：经济法 指导教师：裴丽萍 20060401 华华 中中 科科 技技 大大 学学 硕硕 士士 学学 位位 论论 文文 I 摘摘 要要 著作为权利之源泉，著作权之客体；著作人乃权利之归属，为著作权之主体。 有著作才生著作权；有著作权，法律才有加以保护之必要。因此，著作与著作人是 著作权法框架的两大基石。作为著作权客体的作品的概念、本质及独创性是什么， 判断作品是否侵权的理论依据是什么，是著作权法首先必须予以解决的问题。 在本文中，作品的概念、本质及独创性之间有着严密的逻辑关系。首先笔者提 出了一个学理上
2、的作品的概念。作品是国家以法律形式认可的（包括正面条件和反 面条件）可版权作品，这个概念本身包含了作品的本质和构成要件。 “思想/表现二 分法”是形成作品概念的基石，而作品的本质就是通过研究动态的“思想/表现二分 法”作品形成的过程得来的。作品的本质是思想和形式载体的统一，这是对“思 想/表现二分法”的高度诠释。独创性是作品构成要件的首要条件，作品的概念体现 了对独创性的要求，即独创性是国家以法律形式认可的正面条件之一。独创性进一 步回答了作为作品本质的“思想与形式载体的统一”中的“思想”与“形式”要达 到什么程度才能受版权法保护，实践中也正是通过独创性的研究来深化对作品本质 的认识，于是产生
3、了各国审判实践依据的基本理论和方法“思想/表现二分法” 与独创性理论的结合。 本文正是以作品的概念、本质及独创性之间的逻辑关系进行篇章布局的。首先 明确版权理论中作品的概念及其临界概念，通过对作品的形成过程的研究得出作品 的本质；然后比较研究具有代表性的国家或地区关于独创性的理论的含义，试图揭 示不同法律制度下不同的价值取向。完成上述基本理论研究后，转向实践领域，基 于各国在审判实践中依据的基本理论和方法“思想/表现二分法” 与独创性理 论的结合，提出了判断作品类型的公式和审判思路，并以此进行实证分析，最后提 出了对我国著作权法有关作品问题的建议。 本文没有理论上的创新。但文章从作品的概念、本

The writer is the ownership o
5、f the right, and the subject of the copyright. There is the works that grows the copyright. There are copyrights, the law has a necessity protected. So the works and the writers are two major elements of the copyright law system. As the object of the copyright, what the concept, the essence and the
6、originality of the works are, and what the theoretical bases to judge whether the work encroached right are, these are the problems that the copyright law must be solved at first. There are tight logic relations among the concept, the essence and the originality of the works in this article. An acad
7、emic concept of the works is put forward at first. Works are copyrightable works that the country approves of in the form of law in the country (Including positive conditions and negative conditions). This concept includes the essence of the works and the important document of the composition. The “
8、Idea-Expression Dichotomy” forms the major element of the concept of the works. And the essence of the works is obtained through studying on the dynamic “Idea-Expression Dichotomy”the course that the works forms. The essence of the works is the integration of the thought and the form carrier. Thats
9、the annotation explanatory of the “Idea-Expression Dichotomy”. Originality is the primary element of the important document of the works composition. The concept of the works reflects the requisition for originality, namely originality is one of the positive conditions that the country approves of i
10、n the form of law. Originality answers that to what degree the “idea” and “expression” can be protected by the copyright law further. The studying on the originality deepens the understanding of the essence of the works in practice, and then brings the combination of the “Idea-Expression Dichotomy”
11、and the originality theory, which is the basic theory and method of justice basis in different countries. This article arranges of the chapter under the logic relations among the concept, the essence and the originality of the works. Firstly, it defines the concept of the works and its critical conc
12、ept in copyright theory, and works out the essence of the work through studying on the forming process of the works. 13、nder different legal systems. After finished above-mentioned basic theoretical research, it turns to practice field. Under the combination of the “Idea- Expression Dichotomy” and the originality theory, which is the basic theory and method of justice basis in different countries, it proposes the wor
14、ks type formula and the justice train of thought so as to carry on the real example analysis, and put forward to the suggestion about the works of copyright law in our country finally. This article has no innovation in theory. But it carries on studying on the logic relations among the concept, the
15、essence and the originality of the works, which reflects the peculiar research visual angle. According to the available theory, the author put forward the concept and the essence of the works, the combination of the “Idea- Expression Dichotomy”, etc., which are the original research findings. 16、eserves to be mentioned are that the works type formula and the justice train of thought which the author put forward can be said to be an innovation on method.
