2、surance Policy or other Certificates of Insurance as well as such other insurance application documents, statements, comments, affixed endorsements or other written documents as related hereto. Any and all such arrangements as involved hereunder shall be made in writing.Provision II Any and all gove
3、rnmental agencies, enterprise and public institutions, social groups, individual economic organizations and other legally established organizations within the territory of the Peoples Republic of China (exclusive of HKSAR, Macao SAR and Taiwan, the same applies below) are deemed to be qualified enou
4、gh to be the Insured hereunder.Insurance coverage Provision III During the insurance period, in the event of any injury or decease of the Insureds employee incurred under any such circumstances as listed below, the Insurer shall undertake to pay the indemnifications hereunder against any such indemn
5、ification liability as to be borne by the Insured for the afore-mentioned injury or decease in accordance with the laws of the Peoples Republic of China (exclusive of HKSAR, Macao SAR and Taiwan, the same applies below).(I)Injured in a work-related accident at the workplace during the working time;
6、(II)Injured in an accident when making work-related preparations or conducting work-related winding-up work at the workplace around the working time; (III)Injured by violence or other unexpected hazards in performing work-related responsibilities at the workplace during the working time; (IV)Afflict
7、ed with an occupational disease;(V) Durante absentia for work, injured due to work or the whereabouts thereof is unknown due to an accident;(VI)Injured in a motor vehicle accident on the way to work from home or back home from work; (VII)Died of an acute disease breaking out during the working time
8、and at the work spot or died of the unsuccessful emergency medical treatment within 48 hours after the acute disease breaking out. (VIII)Injured in protecting the interest of the State and the public, such as in dealing with an emergency or providing disaster relief; (IX)The Insureds employee is wou
9、nded or becomes disabled in war or on duty during the term of military service and is therefore given a certificate for injured or disabled serviceman, but the previous injury recrudesces after working for the employing unit.(IX)Other circumstances that shall be identified injured at work as provide
10、d by laws and administrative regulations. Provision IV In the event of any insured accident, as a result of which either arbitration or litigation has been raised against the Insured, the Insurer shall also take such liability as to make indemnifications hereunder against any such arbitration or lit
11、igation expenses as imposed on the Insured as well as those other necessary and reasonable fees (hereinafter referred to as “Legal Fees”), which shall be paid by the Insurer as per the prior written consent.ExclusionsProvision V The Insurer shall not undertake to pay any indemnification for any clai
12、ms against such losses and damages as a result of:(I) Any such willful misconduct or gross negligence as committed by the Insured or any of its representatives; (II)Wars, hostile actions, military actions, armed conflicts, terrorism activities, strikes, riots and/or civil disturbances; (III)Administ
13、rative and/or judicial acts;(IV)Nuclear radiation and nuclear explosion; (V) The Insureds employees access to or use of the material containing radioactive substance; (VI)The Insureds employees access to or use of the asbestos, asbestos products and/or other substances containing asbestos. Provision
14、 VI The Insurer shall not undertake to pay any indemnification for the personal injuries of the Insureds employee for any of the following circumstances:(I) Willful misconducts, criminal activities and violation of security administration laws and regulations; (II) Self-injury, suicide or drunkennes
15、s; (III)Taking, inhaling or injecting drugs;(IV)Driving a motor vehicle after drinking alcohol or taking such psychiatric medicine or anesthetics as under the State controls; (V) Driving without a drivers license or driving a motor vehicle during such period when his/her drivers license has either e
16、xpired or been detained, withheld or cancelled by law, or driving such other motor vehicles as inconsistent with the vehicle types of permitted driving specified in his/her drivers license; (VI)Using various special-purpose machines, special equipment or special vehicles or other similar devices without any such valid operating qualification certificates as issued by
