对外经济贸易大学 硕士学位论文 计算机犯罪侦查及电子证据应用问题探析 姓名：都根杰 申请学位级别：硕士 专业：法律硕士 指导教师：孙利 2010-09 I 摘 要 摘 要 电子计算机以及基于计算机技术而产生的互联网的广泛普及运用和快速发展， 极大地推进人类快速步入信息化、网络化时代这一科技发展在给现代社会带来巨 大而深刻信息技术革命的同时，借助于计算机及互联网这一快速信息处理和传播平 台，进行违法犯罪活动也有了新的发展变化，打击犯罪面临着前所未有的新情况、 新问题和新挑战正是由于这些新变化，给刑事侦查工作理论和实践带来了一个新 的研究课题——计算机犯罪侦查及电子证据问题在涉及到计算机及网络犯罪案件 中，传统证据已无法达到清楚证明案件事实的要求，取而代之的是电子证据成为证 明案件事实必不可少的证据类型然而，对案件侦查来讲，传统的调查取证方法不 能直接照搬来用于电子证据的收集，如何更加全面有效地收集电子证据、应用电子 证据就成为侦破这类案件的关键但是，在计算机犯罪犯罪案件侦查以及电子证据 收集应用等方面存在许多难点问题，如何克服这些难点问题将是影响案件侦查的重 要因素为此，结合工作实际，就计算机犯罪侦查及电子证据应用问题进行了初步 研究探索，形成本文。
全文共分 5 个部分，下面仅对文章的主要内容作简要阐述： 一、前言简要介绍当前计算机在人们工作、生活中得到了广泛应用、普及和 快速发展，在给人类文明带来灿烂辉煌新篇章的同时，利用计算机等先进技术从事 违法犯罪活动也相伴而生自从 20 世纪 90 年代以来，各类刑事案件中越来越多地 涉及到计算机，如何遏制和有效打击计算机犯罪，已是世界各国共同面临的新的社 会问题 二、计算机犯罪的概念、特点及发展趋势计算机犯罪伴随着计算机的普及而 多发，随着计算机技术的发展而发展，分析和研究计算机犯罪的概念、特点以及在 未来社会中计算机犯罪的发展趋势，对于预防和打击计算机犯罪具有重要意义 三、计算机犯罪案件侦查工作中面临的难点问题计算机犯罪属于新型高科技 犯罪，由于技术局限以及法律制度滞后等原因，目前，从司法层面上对打击计算机 犯罪不能产生足够的威慑力量，导致计算机犯罪呈现日益增多的趋势回归到现实 社会生活，从实践中分析可见，计算机犯罪案件普遍存在发现难、管辖难、取证难 等诸多难题 四、计算机犯罪案件侦查中电子证据的采集应用及难点问题随着计算机及网 络技术的广泛应用普及，涉及计算机的案件也越来越多，呈现加速趋势。
如何快速、 高效侦查这类案件，继而严厉打击处理这类高智能、高科技犯罪，其中证据问题占 据着举足轻重的重要地位，它直接关系到整个案件侦查乃至刑事诉讼的顺利进行 然而，电子证据不同于其它传统证据，因此在侦查过程中，获取电子证据时常常遇 II 到这样那样的问题，为司法工作人员提出了新的挑战 五、完善计算机犯罪侦查工作及电子证据立法的建议防范和打击计算机及网 络犯罪案件，需要懂得计算机安全技术，计算机安全管理也需要安全技术，但是计 算机安全技术受制于计算机技术的发展所以，运用司法的强有力手段来发现计算 机犯罪并在计算机及其网络中获取可以作为法庭证据的电子数据证据，是保证计算 机及网络系统安全、严厉打击计算机犯罪的有效途径为此，就计算机犯罪案件侦 查及电子证据应用问题从法律层面上提出自己的意见和建议 关键词：计算机犯罪 刑事侦查 电子证据 采集应用 III Abstract Along with the electronic computer and Internet use, the popularization and development of human, greatly fast into the era of information and network. The development of science and technology in the modern society, to bring a great and profound information technology revolution, by computer and Internet this rapid information processing and communication platform, various messages can be spread in the global scope, instant communication, in the social politics, economy, culture, science and technology development, actively promote the role of human social activities, content and way of life of enormous influence. Needless to say, the socialization of information and make crime, a new development also brings unprecedented crimes to the new situation and new problems and new challenges. It is because of these new changes to the criminal investigation, working theory and practice has brought a new research project of computer crime detection and electronic evidence. Involved in computer and network crime, traditional evidence has proved unable to achieve the case facts clearly, instead of electronic evidence proves the case facts as an evidence type. However, the investigation of cases, to investigate the traditional method cannot directly copy for electronic evidence collection, how to effectively collect more comprehensive application of electronic evidence, electronic evidence becomes the key to solve this kind of case. The article is divided into five parts, below the main contents of this only to briefly described: (1) Introduction. Outlined the current computer work in people, life has been widely applied, popularity and growth, in the splendid glory of civilization brought a new chapter while incorporating advanced Jishu Ji Suanji other illegal and criminal activities Ye hand in hand. Since the 20th century, since the 90's, all kinds of criminal cases are increasingly related to computer, how to contain and effectively combat computer crime, is the world facing the new social problems. (2) The concept of computer crime, characteristics and trends With computer crime, universal and multiple computers, with the development of computer technology and development, analysis and research of Computer Crime, characteristics, and in shaping the future of computer crime trends, for preventing and combating computer crime is important.
