2、arty B) : 根据中华人民共和国合同法、上海市房屋租赁条例(以下简称:条例)的规定,甲、乙双方在平等、自愿、公平和诚实信用的基础上,经协商一致,就乙方承租甲方可依 出租(出租)的 商品房(房屋/商品房)事宜,订立本合同。 In accordance with the Laws of Contract of the Peoples Republic of China and the Tenancy Regulations of the Shanghai Municipality (hereinafter referred to as “the Provisions”), Party A a

3、nd Party B, having reached an agreement based on the principles of equality, willingness and mutual benefit, hereby enter into this Contract on matters in relation to the Lease of the Property by Party A to Party B. 一、出租房屋情况 Condition of the Lease or Pre-Lease Property 1-1甲方出租(出租)给乙方的房屋座落在本市 区(区/县)

6、(房地产权利人/代管人/法律规定的其他权利人)与乙方建立租赁关系。签订本合同前,甲方已告知乙方该房屋已(已/未)设定抵押。 Party A being the Owner of the Property and Party B have developed a lessor/lessee relationship. Before the signing of this Contract, Party A has already informed Party B that the Property has been subject to a mortgage. 1-3该房屋的公用或合用部位的使用

7、范围、条件和要求;现有装修、附属设施、设备状况和甲方同意乙方自行装修和增设附属设施的内容、标准及需约定的有关事宜,由甲、乙双方分别在本合同附件(二)、(三)中加以列明。甲、乙双方同意该附件作为甲方向乙方交付该房屋和本合同终止时乙方向甲方返还该房屋的验收依据。 The area and the use of the public or common part of the Property; the existing fixtures, facilities, condition of equipment and the contents, standard and other relevant

Party A and Party B have agreed the said Appendix shall represent the condition of the Property at the time of hand over of the

9、 Property by Party A to Party B and when Party B deliver up the Property to Party A at the expiry of this Contract. 二、租赁用途 Purpose of the Property 2-1乙方向甲方承诺,租赁该房屋作为 住宅使用,并遵守国家和本市有关房屋使用和物业管理的规定。 Party B warrants to Party A that the Property shall be used for Residential purpose and follows the regul

10、ations of the State and this Municipality in relation to the use and management of Property. 2-2乙方保证,在租赁期内未征得甲方书面同意以及按规定须经有关部门审批核准前,不擅自改变上款约定的使用用途。 Party B guarantee that during the lease term, it shall not alter the purpose of the Property without Party As prior written consent as well as the appro

11、val from the relevant governmental department. 三、交付日期和租赁期限 Delivery Date and Lease Term 3-1甲乙双方约定,甲方于 年 月 日向乙方交付该房屋。【出租】房屋租赁期自 年 月 日起至 年 月 日止。 Party A and Party B have agreed that Party A shall hand over the Property to Party B on or before . 12、. 3-2租赁期满,甲方有权收回该房屋,乙方应如期返还。乙方需继续承租房屋的,则应于租赁期届满前 1个月,向甲方提出续租书面要求,经甲方同意后重新签订租赁合同。 Upon expiry of the lease term, Party A shall have the right to repossess the Property in its entirety and Party B shall deliver it up accordingly. If Party B wishes to renew the lease, it shall submit such intent in wri

13、ting to Party A one month prior to the expiry of the lease and sign a new lease contract with the consent of Party A. 四、租金、支付方式和期限 Rent, Method of Payment and Term 4-1甲、乙双方约定,【出租】月租金人民币( )(大写:人民币 圆整 )。该房屋租金 1 (年)内不变。自第 2 (年)起,双方可协商对租金进行调整。有关调整事宜由甲、乙双方在补充条款中约定。 Party A and Party B have agreed that.Le

15、by Party A and Party B in supplementary clauses. 4-2乙方应于每月 15 日前向甲方支付租金。逾期支付的,每逾期一日,则乙方需按日租金的0.5%支付违约金。 Party B shall pay the rent by the 15th day of each month. Late payment by Party B shall be subject to a penalty of 0.5 % of the monthly rent per day. 4-3乙方支付租金的方式如下: The rent shall be paid by Party B as follows: 参见补充条款,please refer to the supplementary provision. - 五、保证金和其他费用 Deposit and Other Fees and Charges 5-1甲、乙双方约定,甲方交付该房屋时,乙方应向甲方支付房屋租赁保证金,保证金为贰个月的租金,即人民币 元,(大写:人民币 圆整 )。甲方收取保证金后应向乙方开具收款凭证。 租赁关系终止时,甲方收取的房屋租赁保证金除用以抵充合同约定由乙方承担的费用外,剩余部分一周内无息归还乙方。 Party A and Party B have
