1、LEASECONTRACT lessor(hereinafterreferredtoaspartya): lessee(hereinafterreferredtoaspartyb): partyaandbhavereachedanagreementthroughfriendlyconsultationtoconcludethefollowingcontract. 1.locationofthepremises partyawillleasetopartybthepremisesandattachedfacilitiesownedbyitselfwhichislocatedatandingood
2、conditionfor. 2.sizeofthepremises theregisteredsizeoftheleasedpremisesissquaremeters(grosssize). 3.leaseterm theleasetermwillbefrom(month)(day)(year)to(month)(day)(year).partyawillclearthepremisesandprovideittopartybforusebefore(month)(day)(year). 4.rental 1)amount:therentalwillbepermonth(includingm
3、anagementfees).partybwillpaytherentaltopartyaintheformofcash. 2)paymentofrentalwillbeoneinstallmenteverymonth(s).thefirstinstallmentwillbepaidbefore(month)(day)(year). eachsuccessiveinstallmentwillbepaidbydayofeachmonth.partybwillpaytherentalbeforeusingthepremisesandattachedfacilities(incasepartybpa
4、ystherentalintheformofremittance,thedateofremittingwillbethedayofpaymentandtheremittancefeewillbebornebytheremitter.)partyawillissueawrittenreceiptafterreceivingthepayment 3)incasetherentalismorethan7workingdaysoverdue,partybwillpay0.3percentofmonthlyrentalasoverduefineeveryday,iftherentalbepaid10da
5、ysoverdue,partybwillbedeemedtohavewithdrawnfromthepremisesandbreachthecontract.inthissituation,partyahastherighttotakebackthepremisesandtakeactionsagainstpartybsbreach. 5.deposit 1)guarantyingthesafetyandgoodconditionsofthepremisesandattachedfacilitiesandaccountofrelevantfeesaresettledonscheduleduri
6、ngtheleaseterm,partybwillpaytopartyaasadepositbefore(month)(day)(year).partyawillissueawrittenreceiptafterreceivingthedeposit. 2)unlessotherwiseprovidedforbythiscontract,partyawillreturnfullamountofthedepositwithoutinterestonthedaywhenthiscontractexpiresandpartybclearsthepremisesandhaspaidallduerent
7、alandotherexpenses. 3)incasepartybbreachesthiscontract,partyahasrighttodeductthedefaultfine,pensationfordamageoranyotherexpensesfromthedeposit.incasethedepositisnotsufficienttocoversuchitems,partybshouldpaytheinsufficiencywithintendaysafterreceivingthewrittennoticeofpaymentfrompartya. 4)ifpartybcant
8、normallyusetheapartmentbecauseofpartya,partyashouldreturnthedeposittopartybatonce.and,partybhastherighttoaskforthepensationfrompartya 6.obligationsofpartya 1)partyawillprovidethepremisesandattachedfacilities(seetheappendixoffurniturelistfordetail)onscheduletopartybforusing. 2)incasethepremiseandatta
9、chedfacilitiesaredamagedbyqualityproblems,naturaldamagesoraccidents,partyawillberesponsibletorepairandpaytherelevantexpenses.ifpartyacantrepairthedamagedfacilitiesintwoweekssothatpartybcantusethefacilitiesnormally,partybhastherighttoterminatethecontractandpartyamustreturnthedeposit. 3)partyawillguar
10、anteetheleaserightofthepremises.incaseofoccurrenceofownershiptransferinwholeorinpartandotheraccidentsaffectingtherightofleasebypartyb,.partyashallquarantcethatthenewowner,andotherassociated,thirdpartiesshallbeboundbythetermsofthiscontract.otherwise,partyawillberesponsibletopensatepartybslosses. 4)pa
11、rtyamustregisterthiscontractwiththerelevantgovernmentauthorityifnotdoingsoresultingthatthiscontractisinvalidorpartybsrightofleasingmaybedamaged,partyashouldtaketheallresponsibilities.partyashouldalsobearthealltherelevanttaxes. 7.obligationsofpartyb 1)partybwillpaytherentalandthedepositontime. 2)part
12、ybmayaddnewfacilitieswithpartyasapproval.whenthiscontractexpires,partybmaytakeawaytheaddedfacilitieswithoutchangingthegoodconditionsofthepremisesfornormaluse. 3)partybwillnottransfertheleaseofthepremisesorsubletitwithoutpartyasapprovalandshouldtakegoodcareofthepremises.otherwise,partybwillberesponsi
13、bletopensateanydamagesofthepremisesandattachedfacilitiescausedbyitsfaultandnegligence. 4)partybwillusethepremiseslawfullyaccordingtothiscontractwithoutchangingthenatureofthepremisesandstoringhazardousmaterialsinit.otherwise,partybwillberesponsibleforthedamagescausedbyit 5)partybwillbearthecostofutil
14、itiessuchastelephonemunications,water,electricityandgasontimeduringtheleaseterm. 8.terminationanddissolutionofthecontract 1)withinonemonthbeforethecontractexpires,partybwillnotifypartyaifitintendstoextendthelease.inthissituation,twopartieswilldiscussmattersovertheextension.underthesametermspartybhas
15、theprioritytoleasethepremises. 2)whentheleasetermexpires,partybwillreturnthepremisesandattachedfacilitiestopartyawithindays.anybelongingsleftinitwithoutpartyaspreviousunderstandingwillbedeemedtobeabandonedbypartyb.inthissituation,partyahastherighttodisposeofitandpartyawillraisenoobjection. 3)thiscontractwillbeeffectiveafterbeingsignedbybothparties.anypartyhasnorighttoterminatethiscontractwithoutanotherpartysagreement.anythingnotcoveredinthiscontractwillbediscussedseparatelybybothparties. 9.breachofthecontract 1)duringtheleaseterm,a
